Non EU mommy of Swiss children

I have 2 elder non eu children whom are studying in Switzerland and 4 Swiss children at school. I have recently got a divorce from their Swiss father and the Judge felt it would be in their interest if they remained with their Swiss father because I have stayed at home for 20 years looking after the children, so no profession as well as the fact that it is a risk that I will leave Switzerland to return to South Africa. Myself and my two elder children have had to renew our B-Permits which have been refused for the two that are studying. We have been living in Switzerland for 10 years so you can imagine how difficult it will be for them to return to SA, they can only speak French....as for me, I am still waiting to hear if I will get my B-Permit renewed, which is doubtful because I am not yet employed and does not look very promising these next few months. Is it possible for the authorities to refuse me a B-Permit if I dont find employment, please not my divorce went through in December 2007.....bit of a panic here

I'll be the first to admit that I know nothing about family matters, but this sounds like a really sh!tty situation. I do sympathise. Having read your post something struck me, do you have any possibility for appeal? Since you were the main care giver for the children then surely that should count for something. Is the father going to stay at home for them, help them with their homework, bring them to the doctor when they are sick etc... Surely as the person who took care of all this you have a leg to stand on with an appeal... but maybe someone more versed in Swiss family law can advise on this.

Also... Surely you should be able to stay here as the parent of Swiss citizens, and your other chldren should the be able to stay as dependants of you(Unless they are over 18).

I'm sorry I can't give any proper advice. I wish you the best, and hope things get a little better in the near future for you.

You must have had a lawyer for the divorce but given the outcome I would certainly be looking for a different one to deal with this matter.

Its been a long time since you post so im a little curious...

Did you manage to get your Permit?
How about you 2 elder children? They got it?
You find a job?

How you 4 swiss children handle the divorce? Are they OK?
