Can employer in one canton ask for work permit from another canton?

Background: My spouse is on sabbatical leave from a Canadian university to do scientific research. He plans on spending a lot of time in the lab (located in the canton of Fribourg) but the Swiss university he is visiting is in the canton of Vaud. Does anyone have experience with this kind of situation? Can a university in the canton of Vaud apply for a residence permit to the canton of Fribourg? I am assuming a non EU can't have a permit from one canton and live in another? Our Swiss contact is asking the correct offices, but I'd also love to hear from anyone in the Forum who can shed some light on this.

No, they can't. You have to live and work in Vaud and I'm really not sure how much work, if any, he'd be able to do at Fribourg uni. After all, he's working for a different uni in a different canton. I guess it depends on how much co-operation there is between the two.

I'm not sure what the process is myself as my supervisor did it for me, but as a PhD student (from Canada) I'm registered at the University of Bern but I live in Zurich (and got my residence permit for Zurich), as I spend most of my time in the lab at the ETH Zurich. I commute once a week or as needed to and from Bern. I don't think it caused too many issues in terms of permits, but perhaps they need to confirm some sort of collaboration, and I'm not sure what paperwork is needed for that.

You do not need to live an work in the same canton. It is best that your employer requests the permit for the canton you want to live in. Then working in the other canton is not a problem.

You can read the "law on foreigners" here, specifically these two sections: (I'm very sorry, I don't have it in English. If you change the "fr" to "de" or "it" you should get it in German and Italian).

Art. 37 Nouvelle résidence dans un autre canton
1 Si le titulaire d’une autorisation de courte durée ou de séjour veut déplacer son lieu de résidence dans un autre canton, il doit solliciter au préalable une autorisation de ce dernier.
2 Le titulaire d’une autorisation de séjour a droit au changement de canton s’il n’est pas au chômage et qu’il n’existe aucun motif de révocation au sens de l’art. 62.
3 Le titulaire d’une autorisation d’établissement a droit au changement de canton s’il n’existe aucun motif de révocation au sens de l’art. 63.
4 Un séjour temporaire dans un autre canton ne nécessite pas d’autorisation.

Art. 38 Activité lucrative
1 Le titulaire d’une autorisation de courte durée admis en vue de l’exercice d’une activité lucrative salariée ou indépendante peut l’exercer dans toute la Suisse. Il peut obtenir l’autorisation de changer d’emploi lorsque des raisons majeures le justifient et que les conditions fixées aux art. 22 et 23 sont remplies.
2 Le titulaire d’une autorisation de séjour admis en vue de l’exercice d’une activité lucrative salariée ou indépendante peut l’exercer dans toute la Suisse. Il peut changer d’emploi sans autre autorisation.
3 Le titulaire d’une autorisation de séjour admis en vue de l’exercice d’une activité lucrative salariée qui veut entreprendre une activité lucrative indépendante peut obtenir une autorisation s’il remplit les conditions fixées à l’art. 19, let. a et b.
4 Le titulaire d’une autorisation d’établissement peut exercer une activité lucrative salariée ou indépendante sur tout le territoire suisse.

Note: autorisation de courte durée is an L permit autorisation de séjour is a B permit.

As a non-EU I suspect their permits may be tied to hubby's employer which is the university in Vaud. Still, could be wrong.

If you change the "fr" to "en" you'll get it in English.

It doesn't matter if the permit it tied to the employer. The rights to work anywhere in Switzerland still exist. Also, a change of job is not excluded.
"A change of job may be approved, if there is good cause and the requirements of Articles 22 and 23 are fulfilled."

I tried the "en" and it didn't work. Maybe there was glitch at the time. I'm glad they do have in English also.

I much appreciate your replies! glad to know the federal law addresses this. It looks like the cantons will likely allow us to do this in this case, fortunately. I hope the commune has run across this before when we go to register.
