Permit expires today, renewal in question... what can I do?

I've posted on another thread about the long saga of my permit.

My permit expires today. I (finally) got hold of my legal guardian's office this week. They confirmed that they have sent all the documentation to the Service de la Population, and also said that the commune office at ST-Prex had told them there was a one to two month delay on permit renewals.

I'm a little uncertain on what to do now. I did not receive a letter inviting me to renew my permit, so I have no proof that I have done so (which I understand from reading other threads is what one normally does in this situation). Plus as I have a working permit and I'm not in work the renewal is not 'clear cut'.

What can I do to get some kind of documentation that shows that my case is in the process of being considered and that I'm not just staying in the country after my permit has expired? (I'm EU by the way).

I was supposed to go on a camp in France with the other residents of the foyer where I live in September but we're all agreed that unless my permit is renewed that's out of the question.

I know it sounds silly but I'm worried about being 'controlled' by the police or something and not having any valid document that says I have a right to be here.

Any ideas?

Why would you not go to France? With an EU passport, you should have no issues in either country!

As long as your permit is still pending, I think you're fine, and as IM said as an EU citizen you shouldn't have any problems. If you do get controlled, you don't have to tell them your whole story. Just tell them the renewal is in the works, but there's a backlog. They can check that pretty easily if necessary. More likely they want to know how much meat and other goodies you are bringing back.

In the meantime, is there no way you can get a written statement from the Service de la Population or at least your legal guardian with the status as it presently stands?

It's more that the people who run the foyer are not willing to take the risk... they are concerned we might run into unexpected complications.

The Service de la Population are almost impossible to contact. But I'll ask my legal guardian when he returns from his holidays.

U get a paper from the commune thats stamped and says your application is delayed/ pending but as eu citizen you appear to be worrying about nothing for some reason.

Excuse me if this is a dumb question... but why does the fact that I'm an EU citizen mean I'm worrying about nothing?

Please enlighten me as I'd love to be able to cross something off my worry list.

Not having a residents permit will affect Vhl22's right to claim benefits though, which I think is what she's really worried about as she won't have any income.

Until she gets a yay or a nay to her renewal application I would imagine she's safe enough although what happens if the renewal is refused is a different kettle of fish.

But it won't stop her travelling to France. EU passport = freedom of movement. Swiss permit or not the OP has no issues with an EU passport travelling to and visiting/working-in France. Coming back to Switzerland also is no issue, Schengen = no checks, but even if the OP was checked she is entitled to enter as a tourist…. I've come and gone between permits on a regular basis with no issue at all (from the UK where you do get your passport checked on entry to CH).

Of course it won't stop her going to France and re-entering Switzerland, the travel issue is an non-problem being used as an excuse by the OP's foyer (as she herself realises), to avoid any possible problems for themselves before the permit renewal is sorted, or not.

Whether to'ing and fro'ing between France and Switzerland is possible wasn't the question being asked, Vhl22's query is what can she do about her permit renewal given that the current permit has now lapsed.
The answer is 'nothing', as the renewal application has been made and she's just got to wait for the wheels of swiss bureaucracy to grind on.....

a) you can travel to France, stop worrying
b) your permit renewal is being processed and thus you are not being required to leave the country until that decision is made and if it is not favourable then the appeal process too
c) you're in Schengen with an EU passport, nobody's going to think twice about anything

Whether you do or don't go to France has no bearing on anything else. The situation will not change. Stop worrying yourself silly about something that needs no worrying about.

Thanks for all the replies.

Just to clarify, with the France issue I was more moaning about the fact that due to a decision not made by me I will miss out on my first holiday for four years.

On the permit issue (which was my main concern) it seems that I can get a document from the commune office stating my permit renewal is pending, and that, in the meantime, I need to wait and be patient.

As this issue has already resulted in one hospitalisation and a stay in the intensive care room on suicide watch then perhaps some members may realise that in my case 'worrying myself silly' is a serious problem, which I try to cope with by getting as much information as possible... even if to others it's a non-issue.

Its been posted on here a million times (or more) that EU permits are just a formality, so why you worrying yourself to death over it?

Hubby and I have just been to hand in the forms to renew our permits.
We were told that it would take 2 to 3 months for them to come through, and if for any reason they arrive after the expiry date and we need them before that, a letter will be provided to cover us until the permits arrive.
I hope that is some help to you, best of luck.

Edit.. To be honest, I have never been asked for my permit in all the years I have lived here, even at the airport (I am EU)

If you get the document from the commune could you not get them to reconsider their decision regarding the French trip?

With your British passport and the commune document there us no reason for you not to go and surely the trip will be beneficial to you in your recovery.

So sorry you are going through all this. But could it not be that the last but one line of your last post is the reason they may think the French trip is not suitable for you in those conditions? Hope it all works out for the best.

A happy ending to this story as a one year L permit (without lucrative activity) arrived in the post today! I have another year here, my AI advisor has said he is confident that in a year we can get me to a point where my permit will be renewed again and I get to go to France!
