non EU, self employed contract?

hi all, me and a swiss friend set up a company already and for renew my permit, we need a contract with a salary, as I am non EU, do we still need to prove that we can't hire a EU citizen?

can we write the contact ourselves(is this legal?), or we need a lawyer?

not sure but I have heard that you might need to prove that you have searched enough and not found anyone for the position in EU, then you may hire a Non EU.

might be a rumor, not sure.

Yes. Anyone can write a contract. Whether it's watertight or not is another question.

The case of the non-EU Kazakh citizen, Dina K., to obtain a work permit in Switzerland has similarities to what you are trying to do. To obtain an L permit, Dina K., a daughter of the Kazakh president, presented plans to establish a jewelry company employing about ten individuals and open a factory in Tessin. The company was to employ her as CEO for CHF 120'000 per year. Tessin subsequently granted her an L permit:

From this article it appears that a new business must be of sufficient size and promise to impress the Swiss migration authorities to grant a non-EU citizen a work permit.
