Visa/permit expires shortly before leaving the country for good

Hi all!

We had a difficult time at the Kreisbüro in Zürich today and thought our experience might be helpful to share for others in the future.

Summary:
We're from the US. Our residence permit and visa expires 3 weeks before we're leaving the country to move back to California. We worked with the Migrationsamt and Kresibüro so we don't have to pay the 204CHF fee to renew our permits simply for a 3-week stay.

Details:
For some reason, our visas were issued to expire 4 days before my husband's contract ends. Not sure if this is standard or not.

We will be leaving the country and moving back to the US 3 weeks after our visas/permits expire. (Because my husband's contract ends later than the visa expiration, there wasn't an option to simply leave the country before expiration.)

When we went to the Kreisbüro today after receiving renewal paperwork, they made us pay the full CHF 204 to renew our visas/permits.

However, they later called us back saying they'd refund our money and we didn't need a full renewal.

Here's what we have to do:
  • Present in person at the Stadthaus on the last day of our permit
  • De-register ourselves on the last day of our permit
  • Say we're staying in the country for the remaining weeks as tourists (since Americans can enter without a visa)

And voilà! CHF 204 saved!

Hope this proves helpful to others in a similar situation at some point. I imagine anyone with citizenship that entitles them to a visa-free stay could use this procedure to avoid unnecessary short-term renewals.

Fine...in theory...except if your husband continues to work once the visa has expired...then he's technically working illegally.

Better solution ?

1. Note Work and Residency Permit expiration date.
2. Work contract finishes prior to Visa expiry date (otherwise the employer has to ensure the permit gets renewed).
3. Leave country before your permit expires, or check with the local authorities how long you are allowed to stay as a 'tourist'.

I still can't see how your husband can be 'permitted' to work once the work permit has expired... that's down to the employer (who should know the status of his permit and when it expires)...

Not surprised you had a hard time everyone knows you leave before your permit expires not after!

As prior poster is indicating if your husband works after permit expires he is breaking the law!

This is generally the case for any non-EU who can be here as a tourist without needing a tourist visa. However, I would go back and query your husband's status if he plans to continue working after the permit expires as he would be working illegally then. You may need to renew his permit.

I guess when they realised it was only 4 days, they let it go.

Thanks for the information. I'm in a similar situation, but my work contract end was extended to 6 weeks beyond my permit B expiration date, after which I will leave Switzerland to take up residence in Germany. I am a US citizen.

Any ideas on avoiding the full fee for permit renewal? I'm interested to know the consequences for working illegally without permit...maybe it is a fine comparable to the permit fee?

Worst case it could be a ban to enter the Schengen area. And Germany is Schengen so ....

Think again. Just for overstaying a Schengen visa (tourist basically) people have been fined 550 and 700 Euros. For working illegally it's likely to be more, assuming you just don't get banned straightaway as roegner says. And that ban (from 1 to 3 years) includes all Schengen countries so you could forget moving to Germany.

Pay the permit renewal fee. It's definitely going to be cheaper.

The Swiss authorities can be flexible in ways that probably most people never imagine they will be. Helps to make a good-faith effort to follow the rules to the letter.

If they say that something is fine, it's generally fine. Always check with them first, take names, and be sure to get their decision in writing.

And the opposite if you think you simply can ignore the rules
