If can not get a B permıt

Hello guys


I have been lıvıng and workıng as an Manager in Swıtzerland sınce May 2014 . For the fırst 2 years my permıt was wıth L Permıt as I am from Non-EU country .On May 2016 sınce L permıt can not be extended any more , my company wıll apply for the B permıt . In worst case scenerıo If I can not get B permıt what ıs the regulatıons ? I heard that I wıll have to leave the country wıthın 20 days. Do you know;
1.If I wıll have to leave the country wıthın 20 days do I have to pay the rentıng amount for the months tıll wrıtten movıng date of my apartment as the movıng date would not match what ıs wrıtten ın the contract . Contract is ; 3 months notıce & only end of March or end of september . So wıll I have to pay the rentıng amount from July to October for 4 months?
2. Does the company pay 3 months salary because of the contract 3 months notıce rule ıf I can not get B permıt ? Isnt my contract ıs the one whıch ıs bındıng ?
3. Should I ınform my landlord from now on about the rısk ?


If you can advıse about those questıons I wıll apprecıate

Welcome to the Forum. I can't answer all your questions, but I do know that you don't get out of the rental contract just because you have to leave the country. If you give notice outside of the periods stated in your contract, you will need to find a replacement tenant to take over the lease (or sign a new one). I would not inform your landlord of anything yet, because you could get a new permit and then you would probably want to keep staying there, right?

I see .So I wıll have to waıt and see .Or another optıon ; I can search for tenant and move to my frıends house ıt may work .At least I wouldnt have to pay for whole months rental amount .

Why do you think your permit may not be extended? Your boss is willing to apply for a new one and that tells a lot.

Actually my company has already applied for B permıt wıth nıce letter as per as I know as they ınvıted and applıed for L permıt two years ago me to work wıth them . I only worry sınce the quota has reduced and company ıs layıng off employee ıncludıng swıss natıons to decrease labor cost . They stıll would lıke me to work wıth them but I am not sure about the result from Labor and Economy Offıce . As I am an engıneer I have to make sure I do my rısk assesment

Hi Sena,

I can completely understand your situation as few of my firends went through the same.

1. please note quota has not changed for 2016. its exactly same as 2015, i,e 2500 B and 4000 L for non EU.

2. if your employer in turn the lawyer making the application provides all the necessary proof stating they were unable to find a replacement for you within Swiss and EU, that would be sufficient. Lawyers knows very well on how to deal with it.

3. some time Labour office ask the employer to increase salary for B ( again depending on your current pay )

4. Yes, in worst case, if the permit get rejected, need to leave the country in 3 weeks ( they provide something like RED card for 3 weeks and you need to show return flight ticket to get the same )

5. Rental agreement - you need to check with your employer in reimbursement.
never relay on your landlord or agency to understand your situation and discount your contract period. they never agree to that and you wont get back your advance. offcouse its a business and they wont get the right replacement for your house many time.

6. No - your company never pay's you 3 month Salary simply because, its not their fault. they done their job by applying your permit.
But you need to ask these questions to your Manager/HR since Forum members not aware of the contract between you and your company.

The allocations of non-EU L and B quotas are being exhausted at a fast clip sofar this year. For the first three months of 2016, 29% and 27% of the non-EU permit allocations have been issued:

"Für Erwerbstätige aus Drittstaaten stehen 4'000 Kurzaufenthalts- bewilligungen und 2'500 Aufenthaltsbewilligungen zur Verfügung. Die Ausschöpfung der Drittstaatenkontingente liegt im Kontingentsjahr Ende März 2016 bei 29% für die Kurzaufenthalter (L) und bei 27% für die Aufenthalter (B)."

Is it a problem getting a non-EU B permit if the L permit expires at the end of December?

The quotas will have run out by December for B permits. My work said they will apply in October for it. Hope they don't hit the quota too soon.

My understanding is that the non-EU quotas are for first-time applications and do not impact renewals. This is from a Zurich Migrationsamt presentation:

"Erstmalige Bewilligungen zur Erwerbstätigkeit dürfen nur im Rahmen der jährlich neu festgesetzten Höchstzahlen und unter Beachtung des Artikels 20 AuG erteilt werden. Die einmal gewährten Bewilligungen werden im Normalfall jährlich erneuert, sofern nicht Gründe (z.B. Straftaten, Fürsorgeabhängigkeit, Arbeitsmarkt) gegen eine Erneuerung sprechen."

Note, however, that a non-renewal could occur, according to this presentation, due to, for example, criminal acts, dependence on welfare, employment market conditions.

A thought I've had about the somewhat rapid exhaustion of non-EU L and B permits in the first quarter of 2016 is that this might be due to pent-up demand for permits from 2015. That, of course, is just speculation on my part.
