Re: Refusal to renew B Permit after divorce?

More on divorce here:

https://www.ch.ch/en/divorce/

The relevant section for your questions is here:

https://www.ch.ch/en/right-to-reside...th-or-divorce/

It entirely depends on individual circumstances so no one's going to be able to give you a definite yes, you can stay or no, you'll have to leave.

Until a divorce is finalised you still have your permit so yes if you can find work you can do it. Whether you'd keep your permit obviously depends on what the Swiss authorities decide regarding the length of your marriage and how integrated you may be.

If they decide against you, then either your employer (if you have one by then) will have to apply for a new permit as you'll come under the non-EU hiring criteria, or you'll have to leave the country.

Re: Refusal to renew B Permit after divorce?

No, only when the divorce becomes final if your permit continuation is refused by the Swiss authorities and any employer refuses to go through the non-EU permit application process or any such application is refused.

Re: Refusal to renew B Permit after divorce?

You can stay as long as you're married or until your permit needs to be renewed. Part of the conditions for getting the permit are that you live with your spouse. If that's not happening then the permit may not be renewed. Of course, that will depend on where you are regarding separation/divorce proceedings.

Hello All,

I am married to Swiss for 2 years. I am an Indian. Not yet divorced. But now on the verge of a divorce. Since one month we are living separately. The thing is that, my B- Ausweis is from Bern and I work in St Gallen. I have a wochenaufenthalt in St. Gallen. So last week my wife has informed the Einwohneramt in Bern that I am no more staying with her and we might get divorced. So these guys from Bern called me and told me that I must abmelden in Bern and anmelden in St. Gallen. When I enquired here in the einwohneramt St. Gallen for a kantons wechsel, they told me to first abmelden in Bern and together with the sozialauszug, betreibungsauszug (from Bern), submit the B1 formular here in St Gallen.

The problem is I am now having the status "getrennt leben" & not divorce. So these guys in St Gallen told me that, they have to send all these documents to Auslanderamt for approval. I am employed in a software company in SG since one year. The company is ready to give me any letter to strengthen the process of obtaining a B- Ausweis thru company sponsorship.

Can anyone comment about my chances??? Will it be diffuclt for me to get a B- Ausweis.

Please Advice

Sam
Hallo Sam,

I have similar situation like you, my marriage with Swiss man here in Switzerland almost 2 years. My husband live in zurich (we are separated) and i work already 1 year in Bern. But we just separated in 1 month, now i live in Bern.
In my process of Anmelden, Kanton Bern rejected my request because my B permit almost finish May 2018 (and now March 2018).
So in this case, the one and only i can do. Ask my employer to help me prolong my permit living with Work Permit.
Do you have any suggestions to me, how the process and what should i ask from my employer for the very beginning of the process.(i know latter gonna be alot).

How about you right now? Coz your post was 2008.
Hows your life right now?

Re: Refusal to renew B Permit after divorce?

Your employer will have to go through the non-EU hiring criteria which will cost them time and money. They need to prove they can't find a Swiss/EU national who could do the job.

Only they can answer that. It will depend on whether they think they have a good chance of getting a permit for you.
