EU National & Non EU Spouse Visa Questions

Apologies if this has been asked already I did a search and couldn't find an answer to my specific case.

I am an EU Citizen and have been offered a contract in CH.

My wife is Non-EU, US Citizen.

We have been living in the EU for the past four years, she has a Belgian

My wife as a US citizen go to Switzerland for 90 days without a Visa.

I know I have to apply for Visa for her to stay longer.

Do I have to wait for the termination of my Work Permit Process (B or L) to apply for her Visa ?

Can it be done concurrently ?

Can she enter with me to CH on her US passport and apply when we get there ?

Thanks for your help

Re: EU National & Non EU Spouse Visa Questions

No, you can apply for her permit at the same time. She will need a Type D visa to enter Switzerland from the Swiss embassy/consulate in Belgium.

Technically no she can't apply once she's here because of needing the Type D visa. Depending on the canton she could be told to go back to Belgium to get the visa or even to go back to the States. Best to get it organised beforehand.

Talk to the embassy/consulate in Belgium, they'll advise you on what you need to do.

She us resident in a Schengen country she doesn't need a D visa.

You can arrive together and apply for your permits together.

Re: EU National & Non EU Spouse Visa Questions

Doesn't matter. Switzerland is not in the EU.

I am a citizen of a non-EU/EFTA state in possession of an unlimited residence permit valid for an EU/EFTA state. Do I need visa to work in Switzerland?

Whether or not you possess a residence permit valid for an EU/EFTA state does not affect your status in Switzerland. You are subject to the same provisions on entry and work as people who enter Switzerland from a third state. As a rule, you will need to apply for an entry visa, which will be issued by the Swiss diplomatic representation abroad as soon as you have been granted a work permit.

I had to to join my British husband when we moved here, though that was before the Free Movement Agreement was in force.

She is coming with her EU spouse. What you quote is not related to spouses of EU citizens. She lives in Schengen zone, she is married to an EU citizen, she does NOT need an entry visa. UK is not part of Schengen and as you said when you moved here was a long time ago.
