Is it possible to get back my citizenship and permanent residence?
 
Hello everyone.
I tried to do some research and get an answer but looks like I didn't get that much. I come from Kosovo but I was born in Switzerland year 1996. Back then I had permanent residence (Visa C). Three years after I was born (1999) my father decided to go back and live in Kosovo. So we lost our citizenship. Now I am trying everything to get back and live in Switzerland the contry I am born. I have registered university in Zurich and i'm about to get my student visa this month, but as we know it only lasts for 3 years untill the studies are over. Do any of you have any idea if I can still get my citizenship back just because I am borned in here and if so can you guide me to any office or someone who takes care of this stuff I could easly call them or even go in person because I am right now staying in Switzerland (Wetzikon ZH).
I also know a little bit of German but im not as good as with English.

You can't get your swiss citizenship 'back' because you didn't have it in the first place. Simply being born in Switzerland does not grant you automatic citizenship (unlike some other countries) and the C permit you had at birth thanks to your parents was lost when you moved away as a child.

I'm afraid you're stuck with the student permit and will need to find a job once you've finished your studies if you want to remain.

However, the three years that you spent here as a child will count towards any future C permit, though three years isn't much.

If and only if you were otherwise stateless at the time you were born, you had no claim to Swiss citizenship and only fragile claim to residence, dependent upon your parents' status and/or refugee law.

Not claiming a foreign nationality to which the child is otherwise entitled doesn't work. Thus: Département fédéral de justice et police v. Vilchez, Trib. féd., Cour de droit public, 29 June 1979, A.T.F., 105, 1979, Ib, p. 63, Clunet, 114.1987.674 (Peruvian parents).

That case is a good lesson for US-citizen parents inclined not to report the birth of a Swiss-born baby. While the USG may treat the baby as an alien (based on the legal presumption of alienage for such unregistered cases), nothing obliges the Swiss Government to treat the child as stateless and so make him Swiss. And the Swiss Institute of Comparative Law is there to support them...

The results can be tragic in those cases where entitlement to the foreign nationality expires. I think the Swiss forfeiture of entitlement at age 22 (unregistered children born abroad to Swiss parents) doesn't apply to children of Swiss parents without another nationality. But the UK and some other countries have no qualms about leaving stateless, children born abroad to their nationals under certain facts.

Nice, but OP is not Swiss, was not Swiss and may become Swiss only after the required number of years as resident.

And you can lose your citizenship also in other countries, mine is quite "famous" for that :mad:

Really? How can you lose Dutch citizensip if you were born Dutch?

Only if you live in a foreign country, have double nationality and don't renew your passport.
