Please I need help !!!got a letter from immigration

Hey I'm married to a Swiss guy for 3 years recently he became aggressive and the police came 2 time because of screams . One time he broke my iPhone in front of the police and the other time he punched me . The police told him that for 14 days he is not allowed to meet me . He went to the city hall and told them that he doesn't live in our apartment anymore and I got a letter from the immigration that they want to know why . They asked if we already did official seperation in the court or if we want to be together in the future. We lived together for 3 years we didn't do official separation my question is if I don't want to divorce and he does want does he need to wait 2 years ? I don't want to lose my permit right now I don't have a job he left the apartment and I don't want to divorce so if I don't want to divorce does he need to wait 2 years ? Till I will have permit c ? Because I heard that this is the law ... I don't know what he will write to the immigration...I spoke to my friend and she told me that nobody can cancel my permit .. I really don't know what to do I don't want to divorce because I still love him . What will happen if he wants to divorce and I don't want ? Does he need to wait 2 years ? And during that time the immigration can take my permit ?

Back on topic:
You can divorce anytime as long as both parties agree.
If you divorce your permit is at risk.
Individual circumstances matter.
Go see a lawyer - no-one on here can give you a 100% accurate answer based on the information provided.

The short answers - no and yes. No he doesn't have to wait 2 years and yes your permit could be revoked. However, the latter depends on your circumstances. You're not the first foreign wife to be hit by their Swiss spouse and such circumstances can be taken into consideration regarding the permit.

If you are looking at your permit for this, that may still be at risk.

Obviously I don't know any background..

But how this reads to me :
All you are interested in is not losing the permit.. Some (immigration) may see that as you actually got married to the Swiss guy to get a permit?

My question is if he wants to divorce and I don't want because I still love him and I want to give him a second chance does he need to wait 2 years till he can divorce from me ? Because I heard that this is the law ... And during that time we can be seperated ...

Ok, I don't want to play the devil advocate here, but then, here I am.

If one of the parties does not agree to the divorce, then you need to live for 2 years in a separate address and then the party intending the divorce can file the papers.

However, THE GUY HIT YOU. I am very sorry, but I take a 0 tolerance on domestic abuse. If abuse starts - be it physical or psychological - chances of change are minimal. You should safe guard yourself and get help - move out to a friend, or contact an organisation for help.

If, opposite to what you write, your main concern is actually sticking to the guy so you can get your C permit, I am sorry to say you really need to get your priorities in order.

Seek help - be it for the divorce procedures or against abuse. But don't sacrifice your well being for a residence permit.

For the permit, again this depends on the circumstances of the separation. Contact a woman's abuse centre or a lawyer to check exactly what your rights are. Because one of the conditions generally for a dependent's permit is that you all live at the same address. If he's moved out then that isn't the case and your permit may be under threat. But the fact that he's abused you is a mitigating circumstance as far as the permit goes.

The situation i know of well over 10 years ago but it was a the other way round .. no violence but the Swiss Wife had a psycho problem that made it impossible to live together.

Didn't have to wait 2 years.
Permit wasn't revoked.

He got awarded half of Her pension kasse .

Yes, he has to wait two years of separation (the date you got in writing in the police-report) If you don't agree on a earlier date that is)
Your permit is based on "Verbleib beim Ehemann", check your "Ausweis" (ID), it used to be even written in there. That makes the separation a problem BUT as the reasons for it are obvious and registered by the police it's an other thing again.
You MUST get legal advice. If I find a cheap/free place you can go (you were not an Asylum-seeker before you married, were you?) I will post it here. But don't count on in, meaning look for it yourself too. I imagine the police could even tell you where to go, as sad as it is, you're not the first one in this situation.

Not sure she should move out ... it's the "family flat". She should stay put in my opinion or she'll have even more difficulties (financial etc.) unless she's got a good job.

Why don't you want to divorce? Just because of your permit? Is that really worth it? What's your nationality?

Yes, if you refuse, he has to wait two years. If that is indeed the better option is your personal decision.

Stop asking in a forum and go get a lawyer.

On the permit question ..

If one has a dependant B permit.. And one separates, then the permit would be lost anyway no? So the 2 year wait for divorce would be pointless?


Assuming, god forbid that was the reason for forcing a 2 year wait.
