Apply for swiss citizenship for a child

Hi all,
Sorry if this topic comes back, but the recent thread about this focused on working for NGOs and didn't say much about child citizenship.

My daughter was born in Switzerland, she's now almost 1.5 years old, and I would like to apply for swiss citizenship on her behalf as soon as she reaches 6 years.
Question: can a parent submit a citizenship application for their swiss born child immediately after reaching 6 years residency in CH ?
Is there a minimum age to aplly for swiss citizenship for children ?

Thanks in advance
Cheers

Does she have a C permit?

Has she lived here 12 years?

Does she have a job?

Re: Apply for swiss citizenship for a child

She can't apply at six years old as she won't fulfill the residency requirement.

Under the current law she would require 12 years of residency and the years between age 10 and 20 count double so the earliest she could apply would be aged 11.

Under the new law due to come into force in January 2018 she would need 10 years of residency and a C permit to be eligible to apply. The years between age 8 and 18 will count double so she would be eligible to apply at age 9.

So to answer your question the minimum age is 11 at the moment and will be 9 under the new law.

According to the new law only years between the ages of 8 and 18 count double and the current law it is between the ages of 10 and 20...so that will not help you much at this point.

Re: Apply for swiss citizenship for a child

Also, according to the new law (from Jan 2018) any time spent on 'L' permit would not be counted towards the 10-years eligibility requirement of being a Swiss resident.

So essentially, the first 2 years spent on 'L' permit (which is usually the case with most EU and non-EU's) would be excluded and therefore one has to live for 10-years on a 'B' and/or 'C' permit and making it a total of 12-years in Switzerland before reaching citizenship criteria. Correct?

I´d say mostly with non EU, as EU persons with a unlimited contract get a B

Under the new [now current] law due to come into force in January 2018 she would need 10 years of residency and a C permit to be eligible to apply. The years between age 8 and 18 will count double so she would be eligible to apply at age 9.
This only applies if the child want's Swiss citizenship on its own. No such requirement if the parents get Swiss citizenship and the kids are included. Kids can only be included if they are minors (under 18) and live with the parent to be naturalized.

Re: Apply for swiss citizenship for a child

So under the new law ..

My oldest has a C permit, come Jan she will be resident 7 years and will be 10 years old.. She can apply then? Resident years + age years.

My youngest will be 7 years resident at the same time, also with a C permit but will be only 7 years old.. So cannot apply for another 2 years?

Will probably do it as soon as they are eligible.

Exactly right.
I think you moved fairly recently so you will need to check the communal residence requirements too.

It will probably be much cheaper to wait until you and the missus qualify and apply as a family (especially for the younger one)but the kids are perfectly entitled to apply independently.

Merci BM..
Yeah we moved commune under a month ago so indeed that's a thing..

Getting the passport is much less important for us oldies, I'd probably scrape through the language requirements, certainly by the time i needed to.. Not so much the missus.. So we'll see when the time comes.

Re: Apply for swiss citizenship for a child

Getting the passport is, from my observation, important for all the family members.

Just fast-forward 40 years from now. Your adult children may then be thinking about whether you may need care or help from them, and you and they may be thinking about your relationship, as grandparents, to their children. What an extra strain for them (and you), if they have their lives in Switzerland, but you don't have the papers to live here!

After all, now you are working, but you may later - just the parents, or the whole family - leave Switzerland for a decade or so. If the children return (which they will be free to do any time, having become Swiss), but you can't, the family might end up split.

This forum has several threads about adult children living here, concerned about their aging parents who live abroad but who cannot get the papers to live here. Therefore, to help your [adult] children have peace of mind as you grow old, I'd like to encourage you and your wife to work on all the integration requirements, including language, and to naturalise as soon as you are eligible to apply.

Hello, might you have a current link to a document that outlines the new law introduced in 2018? Thanksk
