Early C Permit for a Doctoral Student?

Hello all,

I have a question for a friend (Non EU)..

Well, he has been a doctoral student almost for 6 years in fribourg canton. And he said that Spomi (foreign police in fribourg) says that after this september, they will not give a work permit to him, because doctora takes around 3 years and he is in 6th.

So he is currently working in a library (part-time 15 hours/week) and he does not have another revenue.

Well I thought about applying early C permit thing but i do not know whether students can apply for it.. He got only B permit entire duration and lives always in fribourg and the gemeinde is also the same. He can speak french and german and he has certificates B2 for french, B1 for german.. His work in also in fribourg and he got letters from his employee and supervisor prof. for spomi but they still said no.. And finally he have not got any social help and no criminal record/tax debt etc.


So now we are looking for a solution to get a work permit for him (even its part time), is it possible to change canton (like bern) and apply work permit there while continuing study.. or what are the possible solutions for that?

I will be really appreciated if you consider the question and answer.

Unfortunately in this case he is not qualified for an early C permit. For this, he would have finished his study and have worked for at least 2 years.

Permit based on PhD study and postdoc does have a maximal duration (6 years). In fully justified cases it can be extended. Why your friend is still not finishing PhD after 6 years? If there is a justifiable reason, he should contact the university to see what they can do.

Otherwise, I am afraid there is no other possibility. Getting another permit from another ground to let him continue PhD is legally impossible. He needs a permit grounded for PhD study to do PhD study.

I was told by the Fribourg SPOMI recently that years spent here on a non-EU student B permit DO NOT count towards consideration for a C permit......so I think the chances of an early C permit are slim-to-none. Sorry.

Also I have a friend from Lausanne who has been told by Lausanne & Fribourg authorities that you cannot be registered as a non-EU student (B permit) for more than 8 years in Switzerland (in theory that is long enough for you to complete bachelors, masters, and PhD).

Having said all that, if he finishes the PhD, he may be entitled to a 6 month job-seeker type permit - I have seen this happen for non-EUs in Fribourg.

@happyrobbie and kiwigeek, the situation seems not so good. I will tell my friend that he has to finish his study asap. I think he also knows that but he said his thesis topic is a bit difficult but however it is quite long time.

So i also see that there is not so much possible for him.
