Non EU -Dependent B to Independent B

Hello ,

I was working om deputation based on my Non EU L permit for two years (deputation from Indian company ) for swiss based client and got married in between.When my L permit ended, i am continuing on same deputation at client location by using dependent B permit.Next year my husband will be finishing his 2nd year of B permit (he also works here on deputation contract from Indian company ) and we are aware that 2 to 3 year B permit extension possibility is very less for for non eu people on deputation.Would like to know , if my employer( deputation based) can apply for my B permit next year?

It will depend on whether your husband gets an extension on his B permit. As he's the main permit holder, your permit is dependent on his. If he doesn't get an extension then he loses his permit and so do you. It's not possible to swop from dependent to independent permits as a non-EU couple.

"The possibility of gainful employment for family members is related, according to art. OASA 26 and 27, to the duration of the authorization of the person granted family reunification. If the residence permit of the spouse is not renewed, the members of his family cannot claim a right to pursue their gainful employment (art.6, para. 2, OASA)."
Section 4.4.1 of the Foreign Nationals Act

Yes. Your employer can apply for you if they want to. They have to through the process that was done for your husband. So I'm not sure if it's that easy. But they can.

If your permit is granted then you will have to apply for the dependent permit for your husband.
