Change of Employer - B Permit (Spoke to Bern Immigration Office)

Hello,

I'am a non-EU (2Years on L & 3.5 years on B). Currently working for an Indian based consultancy.

1. I spoke to the Bern Immigration Office last week and they clearly told me that my B Permit is not linked to my current Employer and I can change the Employer without any issues.
2. I asked them almost 3 times and the person repeated that my B Permit is Open.
I was pleasantly surprised hearing that from the official. Can I trust this information.?
And if that is really the case, will my things go smoother.?

You are based in Lausanne, better check with your local gemeinde, rather than Bern. Usually, the permit also specifies if it is tied to a particular employer.

Hello,
Thank you for a quick response.
I already approached the local Commune offices. None is giving me a clear reply.
And based on many experts advice here on EF, I tried to call the main BERN Immigration Office who actually is the final authority to grant permits and they confirmed this info.
And no my B Permit doesn't have anything inscribed on it related to my current employer (Front & Back). It only says "For Self Employment I need Authorization" with a date as end of this year. (which was always there on all by B extensions).
Any more feedback based on this.?

I have a question for you. I hope you can reply it Well currently I have a L permit and this my 2. year. Next year i think that they will give me a B permit but i do not want also a tied one. Now I am going a german course that is B2. Maybe language is important to get an open B permit. Could you share information regarding open B permit if you know?

It does not matter what they say over phone - your potential new employer must apply for the right to employ you. A formal letter will be issued by immigration to the potential employer approving / rejecting such a request. Normally the employer will have to prove that they don't find anybody swiss or EU for the skill. Once the request is approved, you can resign from the current job and go ahead for the next employer.

No, if it's an open B then all they have to do is take their new employment contract down to their gemeinde office to show they've changed employers. There's no need for the new employer to apply to employ them. That's what an open B is all about; a non-EU with an open B can live and work anywhere in Switzerland without needing authorisation to do so.

Rakesh - get a letter or an email from them confirming this. Verbal assurances are never very helpful. And then you should be good to go.

But why?

If his permit is B, says that he can work, and is not connected to a certain employer he is free to work where ever he wants.

Sometimes things are simple, even in this country.

Can you trust the Bern immigration office that told you 3 TIMES that your B permit is not linked to an employer? Well probably, yes, considering that it's a simple piece of information that is recorded in their system.

The best way is to send a formal request to the authorities (by mail). As you are not from EU/EFTA, immigration office (Migrationsamt) is just a secondary step in approval chain. First must be labor office (Amt für Arbeit und Wirtschaft). Normally, they do (or don't) grant an authorization to work here, based on what, immigration office grant you a permit to stay in Switzerland.
I don't know, how it is in other cantons, but in ZH there is a form available on AwA website (called Anfrage Stellenwechsel), which will result in 3 options: you can't switch your employer; you can, but an authorizations is required; you can switch it without restrictions. I think that would be the best way to be sure.
