| | Prematurely Permit C requested
Hello everyone
My husband and kid will have permit C this month and I have made a request to have it too, filled all the papers, wrote a letter and so on.
My husband made 5 years in CH, he arrived in October 2012, I arrived just in March 2013 and worked with a L permit. In October 2013 I married with my long time boyfriend and then I received the B permit.
Today a letter from immigration came, saying that my request will be rejected, but I have the opportunity to try to ask one more time, but I have to pay! does anyone knows how much will this cost? I would like to try it one more time, but I afraid that could be too expensive.
If I do not try, when can I apply again? March 2018. October 2018, or just in the end of the new B , so in almost 5 years?

Try again once you've been lawfully resident for at least five years and you should be fine; you don't need to wait until your current B permit expires.

my doubt it's about the price of asking for another revision of my process, I'm afraid to be expensive as we have low incomes.

Well it's because then I will have to pay again all the documents needed, plus the new request, I have already payed the criminal report, financial report in 2 cities for both of us, and we will have to pay the new Permit too, not talking about the time that I have lost, walking around to take care of all papers, so if they could help us giving us a little bit earlier, would be perfect, not forgetting that for some job applications they ask for permit C, and that's the main reason.

Normally by law at least 10 years of residency are required. Please see Art. 34 of Foreign Nationals Act https://www.admin.ch/opc/en/classifi...index.html#a34
The 5 years with proof of good integration is already considered "early".
Granting a C even before 5 years of stay really needs very special circumstances and applying for one is normally just a waste of time and money.

Under normal circumstances, a person can often get away with applying one month before the B permit expires, provided that within the month they will reach 5 years. In your case you are not even close to being here for 5 years.
Keep the B and save your money on the appeal. Wait until March 2018 at the earliest, and make sure you fulfill all other requirements.

From my experience and readings at the time I got mine, the date you can ask for the C permit is October 2018 (after 5 years of B), although they contact you 2 months or so before that date to sort it out. So I think it is B for the time being.
