Company dissolved - Permit B

Hi Everyone

I was running a company for last 6 years in Switzerland and was having permit B ( Selbst. Erwerbstätigkeit ist bewilligungspflichtig), as a self employment status. In Sept my company got dissolved. Fortunately, I have currently a job for 40%.

My question is

How should I handle my Permit which is ending by March 2018, Should I inform the authority, to whom, what should I say?

I am from Third World National, was having first L and then B.. now living for 8.5 years in Switzerland.

You should notifiy the cantonal migration and tax offices since it's a change in your status. Whether your employer will have to go through the non-EU hiring criteria to keep you I don't know since I haven't seen anything about changing from self-employment to employed for non-EUs. It's possible the salary may not be enough either if they do have to apply for a new permit for you, assuming they'll even bother since you're not full time.

Is this the only way for you to have a permit? Or are you married to a Swiss/EU national and can get a dependent's permit?

Many thanks for the reply.

I am not married and having no plan like this. Job/ Self Employment is the only criteria to keep the permit.

I have three options

1. I continue to keep the 40% job and ask to extend 100% ( which seems possible and salary is justified according to the law)
2. I am planning to found one company by Nov, it may help to keep my status but again, I am not sure if new company will give required salary
3. I keep 40% and look for 60% job but not sure how the permit will be handled.

Re 2, any new company will I think have to prove they can't find a Swiss/EU national who could do the job. As stated in another of your threads, founding a company here doesn't give you residency rights.

You really need to talk to your cantonal migration office asap to find out what your options are since I assume your permit is tied to your employer which was the now dissolved company. In which case the permit is no longer valid and you shouldn't be working.

Had a talk with the authorities.. They will not take my B permit back, I just have to provide the details of my employer and employer should fill out some form.... They are happy that I have income source and not dependent on RAV.

Apply ASAP for an 'Early Permit C based on Integration'. Checkout the many posts regarding this - search box top right.

I applied for mine in June, and got approval from the canton in September.

Thanks a lot.. your permit was from Cantone Bern?

I cant speak/ read High German, but having very good knowledge of bärndütsch ( Understanding and speaking).. Hence I dont have any certificate.. which is needed I believe.. what is your opinion?

Depending on your nationality, you may or may not need a certificate.

Need of certificate varies - you guessed it - from canton to canton. If it is required, it is worth to travel to wherever in Germany they have an early test date and get the certificate. Other than that, you have to prove integration.

Instead got grilled in French for two hours. It DOES vary per canton.

I am non-EU and applied for and received an early C permit in 2015 in Canton Bern. At that time, no language certificate was required. I had to give a debt register extract, a criminal record extract, a letter from social help saying they had never supported me, and a brief statement about why I wanted an early C (written in German, of course). I am American though, and I think they have a slightly easier time with early C permit compared to some other countries.

Go ahead and apply, it's worth a try.
