Canton/permit change while dependent wife already working

Hello,

I currently hold an academic B permit in Neuchatel. My wife, whose permit depends on me is also working. Soon we will be moving to Zurich and will most likely get the L permit. Since my wife wants to continue her job for the moment, how would this canton/permit change affect her work? Would she get exactly the same permit as me? If they give her the L permit with the right to work and in the future she quits her job, do you think she'll be able to work in another company easily? We're both non-EU nationals.

Welcome to the forum.

Where is your wife working? Because it might be a long commute if it's in Neuchatel.

Yes your wife gets the same permit as you so I think her employer would need to check with the cantonal migration office whether they would be able to keep her on. L dependent permit holders don't have the right to work, the employer has to meet certain labour and market conditions. She must also have a university degree. From the Foreign Nationals Act:

"Family members of a holder of a short-term residence permit (Article 26 OASA) do not enjoy the right to exercise a lucrative activity. The exercise of a lucrative activity is subject to authorization. Upon admission, a request from the employer respecting the remuneration and working conditions in use in the locality and branch must have been submitted. In addition, members of the family of a holder of a short-stay permit (Article 26 OASA) must have professional qualifications (personal qualifications, Article 23 LEtr)."

Since she's already working her employer needs to check whether a change in permit would bring that into force or not.

Thanks for your reply Medea. She works in Fribourg, so it's not going to be easy for her to travel. Her workplace will look into this situation.

Um, even with the fast trains you're talking an hour's commute each way minimum depending on where her workplace is in relation to Fribourg station and where you might be in Zurich. It's doable, but it can be tiring day after day.

In the end I directly got a regular B permit after my academic B permit, so my wife's permit allows her to work without problems.

But for those who might be in a similar situation: my wife's employer asked the immigration office about the situation. They said that in case of a switch from B to L, the dependent person could continue working in the company for 1 year.
