Naturalisation - Can application for a new born be made along with one of the parents

I have been in Switzerland for over 11 years and I am contemplating requesting for Naturalisation. I fulfill all the conditions in the Canton of Vaud.

However I have two questions, wonder if someone on this forum has any insights on these:

1. We have a 7-month-old baby, I am wondering whether under the new rules I can make a joint application with the baby or the baby needs to spend five years in Switzerland before being eligible for the naturalisation.

2. Is a movement to a new place (apartment) within the Canton but outside of the current commune of residence permissible while the application is in the process?

Thanks a lot in advance.

1. You can not apply for the baby with you.
At 7 months s/he hasn't yet met the criteria for naturalisation.

2. Moving out of the commune during the naturalisation process is no longer allowed.

According to the Neuchâtel site children are included in the parent’s application so they baby would be included in yours.

https://www.ne.ch/autorites/DJSC/JUS...ordinaire.aspx

It’s best to check on the Vaud site to see if the same thing applies there.

Moving outside the commune during the process would mean you no longer fulfilled the communal residence requirements so would be a very bad idea.

Re: Naturalisation - Can application for a new born be made along with one of the par

Yes I can confirm what Belgiummum said, I applied after the birth of my son and he was less than 2 months old, But that was before the end of 2017 and the new law came into force on the 1st of Jan 2018.

I am assuming that the link I posted is based on the new law, the information contained within it is certainly different from when my son made his application in 2017.

We have the opposing scenario in which he was eligible to apply due to the years counting double but we weren’t.

I checked the Vaud site before i replied and it said children of naturalized parents need to have lived in the country for 5 years. A 7 month old by default doesn't meet the criteria.

I also looked at the form and it says document to submit for each person include this one:
-attestation(s) de domicile prouvant les 10 années passées en Suisse. Entre l’âge de 8 à 18 ans, les années comptent double

Maybe this is a special case that is not listed on the FAQs. Best the OP calls the commune.

Actually you can move once the commune is done, but you want to check with them before you actually move just to be sure. 16-25 year olds may be able to move before that, check the details with your commune as well.

Re: Naturalisation - Can application for a new born be made along with one of the par

I would say it is possible Art. 30 https://www.admin.ch/opc/en/classifi...index.html#a31

If not it could apply for facilitated naturalization five years later based on Art. 24 https://www.admin.ch/opc/en/classifi...index.html#a24

From the current SEM Handbook on Citicenship:
https://www.sem.admin.ch/dam/data/se...g18-kap3-d.pdf
Quote:
311/41 Inclusion of minor children (Art. 30 BüG)
As a rule, the underage children of the applicant are included in the naturalisation proces if they live with the applying parent (Art. 30 BüG). Infants up to the age of 2 are included without further clarification. Older Children are included if they have lived in Switzerland for at least two years. In the case of children aged 12 and over, the integration criteria in Article 12 BüG must be examined independently and age-appropriately.

I keep my sources secret.

https://www.vd.ch/themes/population/...aturalisation/

https://www.vd.ch/prestation-detail/...80a29214abd6ad

This is the canton law. It says minor children can be added to the parents application. But it doesn't say anything about exceptions to the resistancy requirements for an infant.
