Why don’t you go to the migration office and just ask them. I’ve never found letters or emails to work. The mail is not looked at urgently and replies come back after they’ve taken action, like in your case.

Seems like a mistake. I was under the impression that L permits are only for short-term residents with work contracts 3 to 12 months in length.

That was the case ("on and off work") and may apply still, OP doesn't say the new job is of untedermined duration. So shouldn't he have been issued an L permit in the first place?

Agh...my bad. He did say his contract expired April 2019 and my coffeine-deprived brain thought 2019 is next year, and thus over 12 months in duration.

So OP, it could very well be that it's an automatic change, as your new work contract is short.

The part I do not understand is that OP would have had a B permit valid for 5 years? And if he arrived here in 2015 that one should still be valid. Even if he has a short term contract now.Which makes the early change strange.

Je vous écris concernant votre courrier du 1er Février 2019 et la visite de la police municipale de Bagnes à notre domicile.

Je ne sais pas par où commencer.

Premièrement:


Je suis très déçu que deux policiers se soient présentés à l’heure du souper chez nous et devant mon fils. Ils avaient l’ordre de retirer nos permis de séjours B et ceci sans aucune explication supplémentaires. Il doit y avoir une meilleure façon de gérer des choses comme celle-ci, ne pensez-vous pas?

La police est arrivée le 13 février à notre domicile et nous a remis en main propre une lettre daté du 1er février dont nous n’avions pas connaissance.

Pouvez-vous nous confirmer que le préavis de dix jours commence le 13 février?

Deuxièmement:

Peut-être y a-t-il un malentendu lorsque j'ai envoyé tous mes contrats et une mise à jour à propos de ma situation à xxxxxx avec le nouveau contrat de travail débutant le 01 mars 2019 avec xxxxxx

J'attendais sa réponse pour savoir si elle avait besoin d’informations et documents supplémentaires..

Chronologie:

- Réception du courrier de Madame xxxxxx le 28 janvier 2019;
- le 30 janvier, j’ai envoyé un courriel à xxxxxx et j’ai joint mon nouveau contrat de travail;
- le 30 janvier, j'ai aussi envoyé une lettre par la poste avec tous mes documents;
- le 31 janvier, xxxxxx a demandé à xxxxxx de signer un contrat;
- le 4 février, j'ai envoyé à xxxxxx un contrat numérisé et signé de xxxxxx ;
- la police du 13 février est arrivée avec une lettre datée du 1er février et a pris nos permis.

Par conséquent, je ne suis pas sûr que vous êtes au claire en ce qui concerne ma situation car vous ne mentionnez pas:

- Mon nouveau contrat à partir du 1er mars 2019 avec xxxxxx .

- Mon contrat avec xxxxxx est valable jusqu'au 28.04.2019 et non le 01.04.2019.

Comme en 2018, il s'agit d'une entreprise du Royaume-Uni, mais je paierai à nouveau tous les impôts en Suisse et je travaillerai au Châble, car je représenterai l'entreprise en Suisse.

Le salaire à 60% est de 4000 euros, mon épouse travaillant également, nous disposerons de fonds suffisants pour vivre.

De plus, j’ai d’autres projets de travail en cours actuellement:

+ J'ai un rendez-vous la semaine prochaine à propos d'un travail d'entraîneur de hockey à xxxxxx

+ Je suis en discussion avec xxxxxx pour devenir directeur des ventes en Suisse.

+ xxxxxx discute avec moi pour une prolongation de mon contrat pour l'été 2019.

+ Ma femme est employée en Suisse depuis le 1er mars 2017, une copie de son contrat actuel est jointe et elle dispose de 2 offres d'emploi à partir du 15 mai.

+ Notre fils va à l'école à Villette et il est très important qu'il ne change pas d'école cette année, car nous avons emménagé à Bagnes en juillet 2018.

Mon épouse et moi-même sommes actuellement employés et j'ai un autre emploi commençant le 1er mars avec des offres supplémentaires commençant le 01.05.2019 après la fin de mon contrat avec xxxxxx.

Je vous envoie le scan de mon contrat de travail à compter du 1er mars.

J'enverrai une copie de cette lettre avec les copies des contrats par lettre recommandée demain à vous et à xxxxxx .

J'attends avec impatience le règlement de cette affaire, car mon épouse et moi-même avons besoin d'un permis pour un emploi futur, voyager et inviter nos parents à nous rendre visite, bref avoir une vie stable en Suisse car nous adorons vivre ici et nous nous sentons bien.

Notre vie sociale est dynamique et nous nous intégrons dans la vie communautaire.

Si le délais se prolonge et la situation ne se débloque pas nous consulterons notre avocat xxxxxx , Martigny.

J'espère que c'est une sorte de malentendu et qu’il sera résolu dans les prochains jours.

I would highly recommend you delete and edit out all names of companies and all names of people involved. Sincerley hope this situation works out for you.

Thank you for the advice. Done.....

And it probably will work out. I hold a Danish passport so it does make things a bit less stressful.
Just wanted to share this as a "warning" that thing like these are possible and you do have to stay on your toes in Switzerland when living on a Permit.

With that said, besides this one time and some small local bureaucracy
Everywhere else I have been treated very nice. Had the most wonderful person helping me at the local chomage etc....

Sorry for the quality.

If anyone wonders why my Salary is "low" for Swiss Standards.

We moved to a new area in the summer and I took a lower paid job to get integrated into the community and to get new friends etc.... Was not happy sitting in Skype meetings all day. Therefore I put a well-paid job on hold.
With my wife's income, we cover our monthly cost and it gave me time to look for work and to wait for a "bigger" contract.

Not how I read the first letter I got. The first letter felt very casual and I sent my new signed contract etc...I must admit now that maybe I should have been more alert when I got the first letter but it sounded like they just wanted some information and it was not sent "Lettre recommandee" and laid in the mailbox for some time.

But it feels my answer got lost somewhere as they don't even mention it now.

Agree that it is clear and delivered by the Police...(2nd letter)

But I see no mention of my signed contract starting March 1st.
+ My wife works and her Permit is connected to mine. Does this mean she loses her job? Does it mean my son cannot finish school?
And as a Danish passport holder, I can stay in the country so it seems strange and the notice is very short.

In my opinion, serious things like this should be discussed at a meeting with the person handling my case. So much gets lost when writing an email. It is happening more and more that we just become a number in the system.

Ones again I am just sharing this so other people can learn from my mistake.

Indeed. That's why email is not the usual way to get anything formal done in Switzerland.

All letters in envelopes from government departments mean serious business. They are never, as you put it, casual, and should not lie in the in box unattended.

And responses to them should never be by mail (unless specifically invited to use mail) but always on paper in envelopes, or by presenting oneself and all supporting documents to the relevant office in person, within the time-frame specified.

Yes, this trend is true for everyone, worldwide, as urbanisation, computerisation and migration increase. It's just a fact of life. It is true even for those who stay where they grew up, and much more so for those who migrate.
