Police came to take away my B permit

Hi All,

So today the police knocked on my door to take away my Permit B and change it for a Permit L.

Backstory:
- From Denmark
- Worked in Switzerland since 2015
- Was on and off chomage from December 1st, 2017 - 1st 2019
- Have a 50-70% work Contract that expires April 28th, 2019
- In the period 1st, 2017 - 1 March 2019 I ones again have worked 12 months and can legally claim chomage.
- I have job offers I am considering that will be starting May 1st.
- Married with my wife working and our son going to the local school

2 Questions:

1. Can the migration office really send the police to collect and change my Permit?

2. Can I claim chomage with an L Permit or look for new work and get it changed back to a B Permit ones I sign the contract?

Thank you all very much

In reply to 1, obviously yes, the Police could only know about your permit situation from the migration office who asked them to intervene

Understand that.

But is that how they do things. Knock on the door while we have dinner and just take the documents. Seems pretty rough and was not expecting this in Switzerland.

I didn't even get a lettre recommandée from the migration office about any decision.

I'd say it's pretty normal sending the cops for stuff.. I haven't heard it about permits but a friend of ours went outside to find that his number plates were gone from his car.. He called the 'service des autos' to report it and was told - 'yeah we sent the police to get it, your insurance expired' .

I nearly got it when I changed car and still had the plate old plate, I got a letter giving me 48hrs to return it or the cops would come get it.

So no great surprise..

Yes sometimes things do not make sense in Switzerland and they throw some curve balls ones in a while.

I'm surprised that they waited so long.

What you did was blatantly illegal.

Re: Police came to take away my B permit

I understood they would have to send a letter, then you could appeal.

I'm confused how they would send the police sans letter?

Makes me nervous for my very own situation. I've been awaiting a letter to appeal, I was told it would arrive, then I appeal and this could take some time.

Is there something missing in your story?

Re: Police came to take away my B permit

After finishing chomage I got a regular mail asking me to give them an update about my new situation and what my plan is for the future.

I sent them a letter back providing them with my current contract and also included my new signed contract offer ( 60% at 4000EURO) starting April 1st. It is a UK company that wants me to do sales in Switzerland.
As I live in Switzerland I pay all my taxes here (AVS in Sion made the decision)

Also explaining that I have 2 other offers that I am considering for the remaining 40%

Next thing I know (10 days later) the police calls me and tells me that they will stop by in 10 min to take my Permit and hand me a letter explaining why.

The letter does not mention my new signed contract offer. I hope they misunderstood something.

Hmmm in Vaud the min to get a permit is lower than the 4000, so I'm confused how 4,000 a month is not enough to keep the permit?

Also if they were going to decline/reject whatever it is in this case I was sure you could appeal? I wonder if they made a mistake? Or vaud is very different?

Re: Police came to take away my B permit

Think it is around 2500CHF in Valais.

I will send them a letter tomorrow with my explanation and I think somehow my signed contract got lost.

Nevertheless, I am surprised how they handle this as it is quite a shock seeing the police with my son going to school and my wife working (Russian but same Permit as me)

You can keep the plates for up to two weeks. Exactly to get a new vehicle on the road ASAP. Our old car broke down. We looked for a new one. Found one. Went to dealer to close the deal and drove of the lot with the new car within 30 minutes. All what is needed is a call to the insurance to get coverage and documents posted by A-post mail to SAN/StVA the same day.

It is a 60% sales job with a UK based company, so not surprised.

I was told by AVS back in 2018 with a similar contact that all taxes should be paid in the country the employer lives and works. So the AVS calculated an amount I paid each month to cover social contributions such as LPP,Chomage etc....

The amount is not that high for one person though. It should be around Fr 2'500.-- for one single person. It goes up progressively if you have dependant spouse and/or children naturally.
For a single person a permit can be secured with only part-time work.

Sorry. Jan 1st 2017 - Jan 1st 2019

And worked 2 jobs while on chomage and now employed until the end of April.

4000 Euro is still a solid amount especially when I find work for the remaining 40%... My wife works as well..

Is your wife’s permit tied to yours? Did they change hers for an L permit too?

Yes it is and she can work with the Permit.
And they took all of them. Did even consider that our son (8 years) is in school etc...

Was thinking they would be more considerate and at least give us a call to discuss or explain. Now I just got a 2 page letter in French handed by the police and of course they could not answer any questions.

60% work for €4'000.-- is equivalent to €6'660 for 100% or about Chf 7'500.-- per month working in sales for a UK company.....

Sounds rather high to me for a temp job
