Family reunification - Non-EU father

Hi All,

I'm an EU citizen with B permit to stay with open contract (no end date),

I want to bring my father to stay with me , he is Non-EU and not living in any EU countries.

i checked Canton Solothorn immigration office web-site and i found the application form, but something strange was written on it.

´´Familienangehörige von EU/EFTA-Bürgern aus Drittstaaten können sich nur auf das Freizügigkeitsabkommen berufen,
wenn sie eine dauerhafte Aufenthaltsbewilligung in einem EU/EFTA-Mitgliedstaat haben, mit welchem die Schweiz das
Freizügigkeitsabkommen abgeschlossen hat.´´


what dose is that means?? my father should be resident in EU???

I think so, but my (possibly flawed) reading of the form's tittle suggests that it is primarily for bringing in spouses who are themselves from the EU. Maybe there is a different form for when the spouse/father/etc is not from the EU?

I'd strongly suggest that you walk into the Solothorn migration office, take a number, and talk to them about what is possible, what form to use, etc.

It's possible you face the same hurdle that others who want to bring a non-EU parent face: You'll need to prove that your father is fully dependent upon you and has been for some time, that he won't be a burden to the state, and that there's no one "back home" who can help him. If he doesn't live with you now, it might be hard to prove he's fully dependent upon you and therefore he must be brought to Switzerland.

^^ I'm still hunting for the source of that info, I know I have seen it before and a link would really help.

I will go to immigration office to check with them.

in attachment i found a form for non EU , but i am a EU citizen!!

Yes, but the nationality of the incoming person is what seems to be important. I guess when the incoming person is EU, treaty obligations change things.

I think the second form is what you need, but based on what 3Wishes said, you may need to provide a strong justification for him to join you in the "Begründung des Gesuches" section. When you talk to the immigration office, try to make sure you get a sense for what is and isn't acceptable.
