Working in India would be a stop-gap arrangement until I can legally start working in Switzerland.

Looking at the timelines of getting the updated resident permit right now, I guess I would have to spend not more than 1 month in India.

If you are not yet in Switzerland, then it is OK to work for one more month in India. but in this case, dont assume that your family reunification permit will be approved in just 1 month and you can come here and work straight away. it takes anywhere between 1-3 months.


if you are already in Switzerland and would like to go back to India for 1 month, it may still be OK as long as you dont deregister (deregistration means you have to apply for family reunification again). so you continue paying your health insurance for this 1 month.

I am already in Switzerland since the last couple of months now.

Since my employer wants me to start in India till I can legally work in Switzerland, I have asked them to check the legality of going to India without de-registration (for upto a month) while the B resident permit is processed here.

One more thing to consider is how you'd handle yourself at immigration when you're sort of between permits.

I left on vacation while my C permit application was processing. My only citizenship at the time was non-EU. The new permit was granted while I was gone. At immigration in Zurich, the officer asked where my permit was, and of course I handed over the B. It's what I had with me, but it had apparently been cancelled upon granting of the C. I was let in since they could see in the computer the permit was approved, but the officer was quite nasty and said that technically I could be denied entry to Switzerland since I didn't have a valid permit with me and I wasn't a tourist. It wasn't a pleasant experience.

Based on your nationality, you need a visa if you don't have a valid permit, whereas under my nationality I could enter without a visa as a tourist. Something to think about anyway.

Thanks for this. As my current permit is valid upto September and I plan to come back in August, I was thinking on the same thing that you mentioned and what happens if the new permit is granted while I am in India. Your experience looks very similar. This is why EF is such an awesome resource!

Is there a possibility of getting a re-entry visa/permit before going to India citing the ongoing renewal? Basically, a document that would enable me to enter Switzerland without any hassle in case my current permit is cancelled while I am in India.

Any pointers on the process, documents, time taken for the re-entry visa/permit?

Hi All and Hyper,

My husband is on L permit and I am on dependent L. Now I got a job offer and my employer is filing a B permit for me.

a. Do I need to ask them to apply dependent B for my husband and kid along with my application.
b. or, do I need to wait for my B and then apply for my husband and kid? If this is the case then my husband will be on L work permit and at the same time I will be on B permit. Is this possible?
c. What is the best way out so that when I get B permit, my husband can get dependent B?

In our case, my spouse's employer had applied for conversion from L permit to a B permit. So, my B permit was also being processed along with my spouse.

There was no separate work authorisation applied by my employer and I waited it out and started work only after both of us received our B permits. In fact, I had to wait 2 weeks after receiving the B permit for the employer formalities to be completed.

Yours is a different situation. Based on what I gather, your employer cannot apply separately for a B permit for you and needs to get a work authorisation on your dependent L permit. You might want to check again with them on the process they intend to do.

Possibly, they mentioned they will apply for work authorisation for you and you misunderstood it as B permit?

Seems like what I mentioned above is how it works most of the time. However, there might be exceptions.

It seems the lady here converted her dependent L permit into an independent B permit while her husband was the primary a L permit holder.

Slight difference from your case was that she was already working on L permit when her employer applied for an independent B permit for her.

Hi Hyper,
Do you mean to say that I will not not get B permit and instead work authorization on L dependent only. However Employer told me that they are apply for work permit and most probably I will get B Permit.
In case if I receive B permit, then what will be the process to apply for my Spouse & kid B dependent.
In case, If I receive L authorization ands my spouse contract get over, then what will happen to my Permit, Will it then convert to B.

I addition to above post, I am currently not working. My New employer has filled for work permit for me only.
My Spouse is on L permit and his contract may get over in 2-3 month.

There is a *big difference* between an EU-L and a Non-EU-L


With a non-EU L dependent there is no automatic permission to work... and no guarantees on whether they can get you your own separate work permit if you are dependent.


Don't quit your current job until the permit is approved.

That seems to be the general consensus and also the rule - see Medea's post on your other thread.

However, the link in my previous post mentions that one of the members here received an independent B permit when her husband was on L permit.

If your employer is applying for a B permit, keep your fingers crossed and hope you get an independent B permit.

Again, as per rules, your permit is linked to the duration of your spouse's permit and cannot be extended if their contract gets over. You can discuss this with your employer in case you reach this situation.
