Asking for advises for Student visa appealling

Dear all,


My student visa application has been denied by Geneva for mainly 3 reasons. 1. accommodation 2. that the need to follow a Master's degree has not been demonstrated to satisfaction. 3. age, 34.

I understand the accommodation part, and I am still looking for it.

However, I don't understand that the need to follow a Master's degree has not been demonstrated to satisfaction? They used 23 al. 2 OASA to deny. I have checked the law that is for job marketing and social environment (I am not sure why. I emailed the school and I am waiting for a reply.

The age one, They used two points to deny.

Has anyone had the same situation? about reason 2 and 3 as I mentioned? And May I have some pieces of advice for it?

Most important will be no 3: your age. Most non EU people over 30 will be denied a visa to study here.

Better check that out before you rent anything.

But I have rent one for appealing reight? And I have read the laws they used to deny, I do not actually see the age part yet

Not all official decisions in Switzerland are according to some codified law. It's just that they cannot be against any codified law.
The policy not to issue student permits to people over 30 years of age is mentioned in section 5.1.1.5 of the federal guidelines on immigration. It is based on a precedent set by the Swiss Federal Administrative Court in this case in 2008.

The authorities will have absolutely no problem refusing your permit based on that precedent alone.

You may appeal the visa refusal to SEM but SEM will likely instantly reject your appeal citing the above. To appeal that in court you will need to:
a) make a court case that your reasons for studying in Switzerland are even more compelling than the ones in the linked court verdict (those were quite compelling indeed, still not good enough for the Swiss).
b) wait a while till your appeal is handled by the Federal Administrative Court, may be a year or two.
c) shell out several tens of thousands of CHF in court and attorney fees.

You will likely lose that court case.
It would be much cheaper and simpler to do your masters elsewhere

I am sorry to hear that. So how is going right now? I am really concerned it because I am also over 30 right now....
