| | Permanent residency for third country national children & their parents
I am a third country national (on carte de legitimation) with 2 kids who are aged 8 and 5 that were born in Switzerland. They are also third-country nationals.
My question is, would these kids ever have a pathway to permanent residency and citizenship in Switzerland? How would that be and when, if possible?
Also, should they acquire Swiss Permanent residency and eventually citizenship, would they be able to file for permanent residency for me (permit B or C). How would that be and when, if possible, including any conditions?
Thanks for your responses to this question.

Thanks for your responses to this question. | | | | | AFAIK the only existing path to a C permit for carte de legitimation holders is managing to reach retirement age while working in Switzerland on a carte de legitimation.
So there's not really one available for your kids. They could try looking for a job when they graduate but their cartes de legitimation won't give them any preferential treatment compared to a random non-EU person not already living in Switzerland. (Graduating from a Swiss university does give a non-EU citizen a grace period of 6 months to look for a job under somewhat less stringent restrictions, but that's still very hard).
Non-EU family reunification in the ascending line doesn't really work for foreigners or Swiss citizens (it does for EU citizens living in Switzerland because of the free movement agreement). Any exceptions must be argued for with the authorities on a case by case basis.

Thanks for your response. It is quite very informative. It is now a curse to have a carte de legitimation while being a third-country national. The sensible thing would have been to request such nationals to opt in to pay income taxes. I am a highly skilled person earning a 6-digit salary per annum but I guess they don't care at all. Who would wait till retirement? It really does not make sense

Thanks for your responses to this question. | | | | | It used to be possible with a Ci permit, but that was changed recently. The only way now, aside from the retirement path, is to find a job here that isn't with an NGO so you could get a B permit, fulfil the requirements to get a C and then apply for citizenship. It would be similar for your kids. Finish school, get a job here and then work towards citizenship.
As for parents that would probably depend on where in the process they tried to do the family reunification. With a C permit it's very unlikely since only spouses and children under 18 are allowed. https://www.ch.ch/en/family-reunification/
If they have citizenship on the other hand then it may well be possible providing they can afford to support you financially. But that would be something to check with the relevant cantonal migration office at the time and also whether the rules have been changed in the meantime.

Third countries are emerging economies with some of the fastest growing economies such as where I come from. It is for reasons other than escaping poverty (if that is what you are conveying in your message). Thank you
