From student to job seeking to CDL to work permit chaos

Hi everyone!

I am new here so sorry for the long post but I tried to include details as I've seen it tends to be helpful in other threads:
  • I am non-EU, recently graduated from a Masters programme in Geneva in mid-Sept
  • Just before graduating, I found a job in Vaud willing to sponsor my working permit. They submitted all documents in Sept and requested a work permit B for me to start by January 2020
  • In the meantime, I applied for the job-seeking visa also early Sept (just before I graduated), to ensure I could stay legally here while waiting on the decision of the work permit. This permit has not arrived yet
  • While studying I was working at a UN agency as a part-time consultant and I have now been offered a 2-month contract for November-December only (so no overlap with new job) to finish a project I was managing. But because I'm not a student anymore and it would be HQ-full time they would issue me a 2 months CDL.

Does anyone know if there is a risk by having a CDL for the 2 months remaining of the year while my full time work permit for January is under review?

And if I get a CDL (which goes through the mission and not OCPM) and shortly after I finally get my job-seeking permit, do I need to give up one of them? Or just ignore the fact I have both, work until the end of the year and wait until I hear about the work permit for 2020?

So much for permit chaos!

You're probably going to have to work with both the Permanent Mission and OCPM on this chaos, tbh.

I'm not a permit expert, but I'm not sure you needed to apply for a job seeker's permit. Your new employer had already submitted paperwork for a permit, and while that request is processing I think you're allowed to stay here since you were already on a valid permit.

I think it may be worthwhile to contact OCPM and ask them for clarification about whether you need a job seeker's permit while the employer's request is in process. If you don't need it, could they please cancel the job seeker's permit request.

If you're issued with a CdL, normally you hand in your "regular" Swiss permit, except you don't have one to hand in. The Mission will have to sort this out. Do they know you don't have a permit in hand at the moment? Consultants might be subject to different rules too, so this may or may not actually be a big deal.

Thank you 3Wishes.

Good point. I was just at OCPM to ask and the clerk said she has no idea. After having to basically beg her, she gave me a visa de retour valid until the end of the year (she textually said there is no need for me to have an ID, I should only stay in Geneva and do not need to travel even to Annemasse). I will show this one to issue the CDL. I do not know what the Mission will say, let's see.

So I guess it's rather safe to have done it. I reside in Geneva and the job application is in Vaud - I hear OCPMs are not so fast exchanging information so better to be safe than sorry.
