Advice & Help Needed ! Tracking down the address of Tenant

Hi Folks,

My tenant has ran away without paying a few months rent. The apartment was not properly maintained and needed repairs and a few appliances are damaged and items missing.

I only have the personís full name , his bank account details and a mobile number.

The person is no longer answering my calls and the address given in the rental contract is a fake one. I have tried to search the personís address via tel.search.ch and directories.ch but unable to find anything.

I do not know how to pursue further and i am turning to the kind folks in this forum for any kind of advice.

I have contacted a couple of lawyers in Zurich and they all need an address to send a demand of repayment.

Is there anyone in this forum who has similar experience or knows which government agency to find out a personís official registered address in Zurich ( I heard that it is possible to pay a small fee to obtain a personís address) ?

Any advice will be greatly appreciated. Thank you.

You can go by the police and perhaps they see a case in it, or you can ge to betriebung and see what they can do with this info.

As for next time: Never rent out without seeing proper ID, but the ID numbers in the contract and have the person sign this.

If this "I only have the person’s full name , his bank account details and a mobile number." is indeed all you have than you asked for trouble.

Luckily you still have the few months rent that you demanded as a deposit...

I guess he is forwarding mail to his new address. Any letters there for him?

Try writing to him, demanding immediate payment and threat of legal action and see if you receive the letter or if it's forwarded to his new address.

If he has left the country, there's nothing you can do.

More fool you, I must say. You need to be more on the ball especially as he hasn't paid rent for many months. I guess he lived out his deposit and scarpered?

Do know his place of employment? His work contract/ the proof he needed to show he can afford to pay the rent when he moved in?

My fulll name is all my landlord started off with me. Okay, she might have my marital status (which was different when I moved in from now) and my birthdate but seriously, I'm not sure.
The mobile number she got some years later. My bank account details she doesn't seem very interested in as everytime she owes me money, she asks for it again.

I never had to show my ID when renting.

However, OP, the 'Gemeinde' (community) usually knows where someone moved to. I don't know under what circumstances they hand out this information, worth asking there.

The 'HauseigentŁmerverband' I'm sure could give you some advice on how to deal with this.

Did you, as you are supposed to do, register the tenant with the city?

Option one, is to try to get the address from the city:

As items are missing and are damaged you could file a criminal complaint with the police.

Be aware that you must try everything possible to get the address:
http://www.servat.unibe.ch/dfr/bger/..._580-2016.html

This means, even if it is fruitless, to ask the bank and the mobile phone provider about the address.

Thank you SwissintheUS and others who had offered some good advice.

I will proceed to the Zivilstandsamt office first to check if i can obtain his residence address. Will try the bank too but i doubt the bank will divulge clientís information.

Failing which, i will have to go to the police for next steps.

No idea if this would work, nowadays, or even go to prove anything... but long ago I heard of someone who was found, in Switzerland, through a letter addressed to Name c/o Bankname. In that case, the sender sent that letter with a covering letter asking the bank to please confirm that they had forwarded the letter, which the bank duly did. In that way, the sender could demonstrate that the letter had been sent.

That's a surprisingly common course of action. Not sure how much it would help you, but if he still has the same employer, they know that a failure to act can affect the future accommodation applications of other employees. I've seen it happen.

In Switzerland? Guilt by association is not a thing here.

But the employer learning that their employee is a rental nomad - as we tend to call those - could influence the tenant's reputation there. So yeah, I'd walk that path, OP.

The deposit cannot be applied to the rent. You need to go to court to get an eviction notice.This is a long process. First you need to send a registered letter to the tenant at the address where they rent from you ( if you have not already done so) and see what becomes of that. Does the tenant still have keys? Are the tenant's personal belongings in the apartment? Is the rent deposit in a bank account? Do you have keys including a mailbox key?

Many people do not have a published telephone listing so it is not surprising that you cannot find the tenant this way. You should ask at the Gemeinde if the tenant has deregistered. If you know their place of employment, you should contact them. Also, if the tenant had any utilities in their name, were these cancelled ? (i.e. internet). You could also try asking other tenants in the building if they know of anything. Asking about a forwarding address at the post office may also be a waste of time if the person moving ticked the box on the form indicating their details not be given to anyone else. I doubt the bank will give you any information, other than the account is closed.

Did you terminate his contract or did he give you notice to terminate?

Not sure what the law is here, but from what you are saying about the condition of the apartment, I assume you entered the property.

I know he didnít pay rent but entering the apartment without certain steps being taken might get you in trouble yourself.

Unlawful entry might be a problem, but this could be one of those cases where the tenant sent the keys back and disappeared. Could be the landlord had a key. For the moment we don't know.

I have spoken to the Police and it is true that despite the errant tenant not paying the rent, it is still considered unlawful to gain entry forcefully or through a locksmith.

Nevertheless, I had gained access to the apartment which have been vacated in a huge mess.

Members on this EF community reinforce my belief that are there still good people around!

Now, next step is to hunt down this bugger....
