Applying for a B permit before the employment contract is ready

I am a British national due to start a postdoc at ETH Zurich (>1 year) on the 1st December. I intend to move to Zurich the previous week to pick up the keys for my apartment and also to apply for a B-type residence permit.

Unfortunately, there has been an administrative delay in preparing the employment contract for various reasons, and it will not be ready until 2 weeks after I am due to start work. The university has said this is no problem, as they can backdate the start of the contract when they issue it. However I am concerned how this will affect my application for the permit.

The advice from the London embassy is that the application must be made at least 1 day before starting work and that I must take proof of employment. On most websites, this is indicated as being the employment contract, however in some places just a "written confirmation of engagement with the employer" is specified. My future supervisor has offered to write a letter confirming their intention to employ me. HR at ETH has also suggested that it is possible to request an extension from the town hall to give me longer to apply.

Does anyone have any experience of a similar situation, of applying for a permit before the employment contract is ready?

An alternative option would be to delay my start date, but I would like to avoid this if at all possible. I am also trying to contact the relevant offices directly, but my German is still very basic so it would be helpful to know what options are available.

Re: Applying for a B permit before the employment contract is ready

"Gainful employment of more than 3 months:

Within 14 days of their arrival and before actually taking up work, nationals of EU-27/EFTA states have to register with the local authorities of the commune in which they are residing and apply for a residence permit. A valid ID or passport and a written confirmation of employment (e.g. the contract of employment containing details of the duration of employment and the number of working hours) have to be presented. A residence permit will be issued depending on the duration of employment: a short-term residence permit (type L permit) for employment of up to 364 days or a residence permit (type B permit) for employment of at least one year or for an unlimited period."

Could your HR department check with the migration office that a letter from the university would be sufficient for registration?

Re: Applying for a B permit before the employment contract is ready

Sorry for the slow reply on this.

As an update, everything worked out. I emailed the Gemeindehaus and a very friendly administrator said that a signed letter from my future employer stating the length of contract and salary would be sufficient and that they could ask to see the full contract at a later date (which in the end they never did).

They even gave me a 5-year permit straight off the bat!
