C permit - abroad 6 months + 1 week

Hello everyone, i’m hoping someone here might be able to help me with this.
I live in Valais, I got my C permit in April and this year ive been away of the country for 6 months. My father has cancer and he’s not doing well at all so I went back to my country to take care of him. Then I had to come back to Switzerland not to exceed the 6 months abroad. When I asked someone at the immigration office they said I wouldn’t be able to get a special permit to travel even if he was dying.
I’ve been waiting for the new year to begin so I can travel again and I was planning on travelling on the 1st January 2020 but now my father is back at the hospital and im not sure hell be able to wait for me to arrive. Id like to spend xmas with him, specially if it will be his last.
So my question is: does anyone here knows what would happen if I spend 6 months + 9 days away from Switzerland? Would they downgrade my permit back to B? How strict are they about it? Does anyone have experience with this? Im about to change my ticket cause even if I get in trouble I felt it’s more important for me to get to say goodbye to him than all the immigration paperwork I would have to go trough but I want to know a bit more about it.

The new year doesn't matter, it's 6 months in a 12 month period.

And you could lose all permits, not just the C.

C permits can be suspended if you have a valid reason (according to them, what you think is of no concern) to be outside the country for longer than 6 months and intend to return, you will have to talk to your cantonal immigration services about this.

Are you EU or Non-EU? If you were away for 6 months I'm guessing you are not working? How do you have your permit, family reunification?

- Firstly, I'd just go! Worry about the permit later. They might not even notice or raise the issue. Maybe you could fly out/in from Italy/France/Germany and it might be less likely that the permit issue would be raised? (I don't know).

- If you are EU, then it will be super simple to re-apply for a permit (L or B) if there is an issue with your C being revoked. Non-EU could be more of a problem.

-If they do try to revoke it, you could probably appeal, with letters and medical records from your fathers doctor.

Leaving the Schengen area, regardless of departure country, would be registred and notified at all entry/departure points so maybe a tad risky (I may very well be wrong)?

I would take the risk and sort the shit out later.


You can always somehow get a new Swiss permit to live here but you can't get a new father
