Urgent: Rückreisevisum expires before I can return to Switzerland

Hi Everyone,


I am stuck in a confusing situation and haven't been able to get an answer from reading other EF threads. I am hoping one of you has been in a similar situation and can advise me.



So here's the problem: I am a Canadian working/living in Zurich on a B-permit. My old permit expired on Dec 31, 2019. I did all the paper work needed for the renewal as per usual and left on travels before the expiry date. Since I had plans to return in early Jan (after the old permit expired) I applied for a Rückreisevisum at Migrationsamt. So far so good.


The problem happened when an unexpected emergency came up and I could not leave in early Jan as expected. The expiry date on my Rückreisevisum is Jan 12 but I may very well be unable to leave till 15th or so.



I contacted the local swiss consulate and they could barely understand what my problem is. They basically said we do not understand why you want a visa as a Canadian when you can just return and your new B-permit will be there. I emailed Migrationsamt again today and mentioned what the consulate said. Migrationsamt insisted that I need to go back to the consulate and ask for a visa.



I have no problem going back to the consulate for a visa but they seem very very unresponsive and I am honestly not hopeful that they will give me a visa anytime soon.



I was wondering what happens if I just return without a new visa and explain to the officer at the airport my situation? will they deport me just because I don't have my B-permit card on me? This whole Rückreisevisum is very confusing to me. Cant they see all my information and renewal and so on on their computer when they scan my passport?


I would really appreciate your input. This is starting to stress me out.

If you have some documentation on hand which can be used to check that your B-permit is still being processed I see no problem at the border, in worst case you have to wait some time so they can verify everything.

No clue about the legal part, but I know of others who have done it like that.

Thanks for your quick response. Actually I initiated the B-permit renewal process and paid the 102 fr fee in early December so I assume it has already been processed. They should be able to see this in their system when they scan my passport.

But they may also ask for the residence permit. I remember once they asked me if I have my residence permit on me in Vienna. I think once they scan the passport they do see that you're a swiss resident and that's why they ask.

Assuming your B permit is approved, they'll see it in the system. Just show the paperwork you have and clarify if they ask. If the officer is a jerk he/she might say that technically they don't have to let you in but they will (this happened to me) but the odds of being completely turned away are very small.

Are you Canadian? Book a return flight and enter as tourist. Sort mess out later.

Do you have someone checking your mail? Let them look if the permit arrived and get it send to Canada by courier.

Print out e-Mail from Migrationamt and bring it to Consulate.

Yeah that's my current plan. Just to show up at the border with a bunch of documents showing I live and work in Switzerland and have already renewed my B-permit and received a reentry visa that unfortunately has expired before my arrival. Hopefully they'll just let it go this time.

Unfortunately I do not have someone to check my mailbox and even if I did, they usually leave a leaflet and ask you to go pick it up with a signature.

It would have been great if the consulate would issue me a new visa but consulates are often messy and congested and are not very efficient. I honestly prefer not to wait an extra week for a visa if I can sort it out at the airport within 30 minutes. I have to be at work sometime next week!

This is exactly what I am hoping for. It should be quite easy for them to verify my status if they can see all my info on the screen. The paper visa or the physical ID card should not be so critical.

Strictly speaking that may not work.... if required you need to be able to demonstrate your purpose for entering the Schengen Area. If the OP can’t show it is as a tourist, then the visa exemption does not apply.

It might be for the airline. They could deny boarding if you do not have a return flight within 90 days.
