Language Requirement for C Permit

Hello everyone,

Iíve applied for the family reunification visa last September and I am still waiting for the permit. Is it regular to take that long? We called the office in Geneva and they said that they are overloaded and they cannot tell us when it will be granted. My husband is Swiss and heís been following up on the matter. The officials told him that my application is still being processed.

My second question is about the language. My native language is Arabic and I majored in English at the university. I understand and read french quite well however my oral and written skills are somehow still weak. I know that there are new requirements that C permit seekers should meet before being granted the visa. I am willing to take French Language courses in Switzerland. But will they require me to take French courses in my native country before moving to Geneva?

I hope you got your situation sorted - as I understood it, C-permit applications were not subject to a language certificate requirement when one is married to a Swiss - also my situation.

However, today I received a letter rejecting my application because I didn't include this evidence, and that I'll get a B renewal instead. If I don't agree with their decision, they say I can appeal, but don't tell me how.

Perhaps someone could tell me if the federal law doesn't apply for some reason in Vaud, and if the error is, in fact, mine? If so, it's frustrating nonetheless, as we were not told about this requirement at commune level, where we told the administrator about our case and required documents in some detail.

I thought the same as you, but in reading the PDF you attached it says that spouses of Swiss citizens need A1 written and A2 oral in order to get a C permit (page 2, second line of the table). That's a document from eda.admin.ch so it doesn't seem to be just Vaud.

IIRC language requirements were standardised nationally as part if thd 2018 reforms?

My 5 year B permit recently expired and I became eligible for the C permit with A2 spoken and A1 written. (married to Swiss)

They requested proof of language certificate before allowing upgrade. Part of the Federal level rules from my understanding. I will likely pass the test fine but I have to schedule a test first. That might be problematic in the time being as I think it must be done in person.

In the mean time I requested they just renew my B-permit which they did no problem.

I hope in a few months after everything clears up I can take the test and upgrade.

Good for you mate. Yes, in the event I settled for the B renewal and wrote a (mild) complaint letter to Aigle commune. They were full of apologies and just told me, when you have the lang cert come back to us and we'll pay for a C application. Pretty impressed by that and will hopefully get the cert and the C before too long! Evidently, it has been a bit difficult to sit a written test due to Covid, but I guess with restrictions easing it should be possible now, touch wood!
