Will Kurzarbeit impact my application on C permit?

Hi there,

I (non-EU) will be eligible to apply for a Swiss C permit in May this year. However, due to the COVID-19, my company decide to apply Kurzarbeit to all employees from next week on. As the (Kurzarbeit) money comes from RAV, I am wondering will this impact my C application?

As I understood, non-EU people cannot receive any RAV benefits when applying for a C permit. But not sure whether Kurzarbeit is the same or it belongs to a different genre because companies instead of individuals apply and it's not my choice at all...

The company is the one who applies for kurzarbeit. In theory you should be fine.

On the other hand, you must sign a form for your employer where you agree with kurzarbeit. This form is added to your employer kurzarbeit application.

So, call a lawyer?

From what I understand Kurzarbeit is on a par with claiming RAV which doesn’t affect your permit and citizenship applications, it is not classed as social help. You are still employed, and I can’t imagine they hold this crazy situation against you. But you could quickly as your gemeinde.

For non-EU C permit application/grant may be tied to employment status.

For early-C (after 5 years), you need to be gainfully employed and have unlimited contract. Being on RAV while doing this will likely lead to rejection. However, I don't know how this applies to Kurzarbeit, if you have a permanent contract reduced to 20%, does it still count as permanent employment? Or there is a certain income threshold then? No idea.

For the after-10-years case, if I am not mistaken, it doesn't matter.

This says that all stays with work purposes count towards the 5 years, limited contract or not.

This is the only work-related document requirement and it simply asks to prove that you have been employed without gaps during the five years. I don't know if being on RAV (ALV) benefits qualifies, but Kurzarbeit definitely does, as you stay employed during it.

Basically, what you said is true if you worked 5 years continuously, with gaps less than 3 months. If there was ever a gap of over 3 months, you need an unlimited contract to qualify, and be not-fired and have passed the probation period at the moment of application. How does this get married with Kurzarbeit is not stated.

I don't think this will impact your C permit since it's a special measure, and your job still exists. The best I think would be to go/call your local immigration office and ask them directly.
You could also ask your employer's HR (Maybe many other employees are in same situation as you) so your company could write a special letter to the immigration office explaining the situation, and that they would like to keep your job.
