Second Master Degree-Student Visa Type D Possible Rejection (Canton of Zurich)

Hello English Forum Switzerland,

I am an incoming Non-EU student starting MSc Statistics at ETH Zurich this Autumn 2020. This will be my first time entering Switzerland, and I already have BSc and MSc in mathematics from elsewhere. So, the MSc Statistics in Zurich will be my second master degree.

This is where I have a concern for national student visa (Type D) application. Only after accepting the offer of admission did ETH send me an immigration guideline which says "Visa applications from students who already have a degree at the desired level may also be rejected." Another page on ETH website outright says "As a rule, visas are rejected if the student already has a degree at the desired level."

I am discussing with International Student Office about this, but I also want to ask around if anyone went through (or know of someone who went though) the similar situation. What were you advised to do? What did you end up doing? How was the ending?

Along with my visa application, I will submit the following personalized documents in addition to routine paperwork:
1. Tabular CV, including records of foreign language skills
2. Letter of motivation: reasons why I want to study in Switzerland
3. Future plans after completion of studies
and can include extra documents.

I plan to include the following information
- reasons for taking a second master degree (changing the field for job opportunities -- I did pure mathematics before deciding it would only lead me to professorship, which is not an ideal job for my post-graduation plan to work near home country)
- plans after completion of studies (immediately move home or to nearby countries in Asia and find a job -- tax and cost of living are lower there, I am the only child and want to be near my family to visit them every other weekend)

Does anyone have suggestions on what information to add or remove? Also, does anyone know where the relevant regulations (possibly in German) are listed, perhaps here? I have seen discussions here, here, here, here and here.

Hey

I have no experience with this but this seems like a very tricky situation. I think you should mention that in your country has a very streamlined system where one needs a degree in statistics to work in [insert desired job posts], and your pure maths degree did not include any statistics module at all and your only available career paths are in [teaching, academia].

This is very tricky because stats is usually a subset of a maths degree, and if you already have a solid maths foundation, stats can be easily self-taught. Even for an outsider, they would know that stats and maths are closely linked and your degree would seem repetitive. Also, a maths degree can already lead you to lots of banking jobs in most countries.

I'd also not mention your personal reasons in staying in Asia (point 2). If you mention how your degree would tailor to your local job market, it already highlights intention to return to home country.

The second thing I might try is to apply for another degree programme like Master's in engineering or finance or computer science.

To everyone, I did some research in the Weisungen und Erläuterungen I. Ausländerbereich on State Secretariat for Migration with the help from Google Translate and found relevant clause:



Bei folgenden Konstellationen wurde die Erteilung einer Aufenthaltsbewilligung zu Recht verweigert:
- Zweitausbildung
- Notwendigkeit einer Ausbildung nach Ansicht der ausländischen Person ist keine Voraussetzung von Artikel 27 AIG (i.c. Zweitausbildung; junge Studierende in Erstausbildung haben Vorrang)

I think Zweitausbildung is the issue, but I do not fully understand the clauses. Could someone who reads German translate these?

There have been several cases on here, of people having been refused visas, either because they already had a qualification at that same level, or because they were over 30 (apparently the Swiss don't consider over 30s worthy of further education!).

I just wrote in another thread but in case you haven’t seen it, I got my visa as a non-eu for a second bachelor degree in the same major in 2017. But as island monkey mentioned, there are many other factors. If you are young, if you have money, if the reasons you give make sense, if you are willing to go back or stay in, and so on. I submitted exactly the same papers you mentioned and a language certificate, nothing more than what they asked. You can use some additional reference letters from university, company or people from/in Switzerland.

I just found your post and was wondering if you have been able to successfully get your visa.
My situation is kinda same as yours, except thay I have admission from UniL, in canton Vaud. I have not heard from my visa yet and I'm kinda getting concerned about the situation.
