Outstayed my visa can i still get married?

Hello dears, I hope you are all doing great during these hard times,


I had a B-permit almost two years ago in switzerland, but my visa was getting looked through so i could have lost it any day (even tho i was legally working and all), at the time I thought itís best if i just go to france and join my family.

After a while i got news that i still had my visa valid there if i wanted to go, but i just didnít know how could i do it and was scared to be questioned where was i...

Now my swiss boyfriend wants to get married and to join him... what i wanna know is if we would be able to actually get married in switzerland since I donít even know the state of my visa (itís probably long gone).
Ps: Iím illegal in france too

Would i be able to get married with these conditions?

So you left Switzerland while your B permit was still valid? But you didn't de-register?

Back in the day when I had a B permit, I remember I had to renew it every year, and fill in a form, sign it, hand it over, and it would be approved and extended. It wasn't renewed automatically. Perhaps that changed now? Are you saying that you "got news" that your B-permit was still valid, a long time after you left?

The visa probably expired already, the only issue might be that you failed to de register and that should not be a big issue.

However one of the requirements to get married is that you can show that you are legally entitled to do so. And that usually requires some kind of documentation from where you have been living. So if you have been living illegally in France that may be an issue.

You need to research exactly what is needed and how you can satisfy the requirements.

Actually Iíd say about 5 months after i left itís probably long gone by now

Why do you think you outstayed your permit? It sounds like you left before it expired? Would think the worst trouble you could get int would be leaving without deregistering. I hope you cancelled your health insurance etc?

What nationality are you?

I'd think your easiest option would be to get married in France. Then afterwards if you want to live in Switzerland, apply for family reunification.

Edit: Sorry mis-read the bit where you said you are illegal in France. Well you are stuffed then. You'd need to go back to your country and sort it from there.

This. You need to leave before you're caught and deported which would result in you being banned from the whole of the EU area including Switzerland. How are you even living there since you're supposed to register as being a resident of France?

I heard there are many illegal people in switzerland... if I donít tell them that i ever left and just go back and act like i Iím just illegal in switzerland, would i be able to get married then?

If i go back to Morocco Iíll be in danger from family (another case that i already had) so can illegal immigrants in switzerland get married?

I might be able to get a job permit in france would that help with it?

You must be legally resident here to be able to marry in Switzerland and I expect the same applies to any EU country.

Actually in france thereís a special procedure for people without papers... to get married to a french person... you just get married and then ask for the permit

I assume that's for refugees. Is that what you are? Or are you actually illegal? In which case I doubt that would apply.

Illegal as in i donít have any papers that give me the right to stay here...
And people like me can actually apply for marriage in france, of course they donít accept them all but they do accept most.

Your fiance would have to apply for a fiance permit for you, but whether it would be granted given your illegal status I don't know.

Yes you can get married.

but then she'd need to stay there, as a schengen over stayer she wouldn't be allowed back in again
