Non-EU - Holding Another EU Residence Permit + Swiss B Permit?
 
Hi All!

Just wanted to throw this question here before we go consult with an immigration lawyer. Y'all might come up with good answers/advice :)

My husband and I (both Non-EU) are currently living here in Dublin, Ireland. I've been accepted for a paid PhD there, so legally, my husband and I will be able to get a B permit.

My husband is currently working for a big tech company here in Ireland (their privacy regulations mean I'm not publicly allowed to say which one). Anyway, due to COVID, the company will be allowing its workers to choose between returning to the office end of this year or working remotely. As my husband's work is "critical work", they will still provide for his Irish residence permit/work permit regardless of which one he might choose.

Now my question is: would anyone have experience with Non-EU holding two residence permits? Would obtaining the Swiss B permit technically cancel his Irish permit or vice versa? As far as I know with Irish regulations, as long as he is not outside of Ireland for 6 months consecutively, he is able to renew his permit. What are the regulations in Switzerland?

I don't know about the double permit side of things. But I've a friend working for a social media company in Dublin who told me that a Non-EU coworker got fired for working from the UK for too long during the crisis when they only had a work permit for Ireland. I don't know the full details but maybe something to consider.

Thanks for this! Sounds like my husband and your friend MIGHT be working for the same company - this company fires people for the most ridiculous reasons.

My husband plans to spend at least a week or two monthly here in Dublin, so he won't be living out of Ireland completely. Our plan is to keep a "permanent address" here plus he will be coming to Ireland every month or so due to work commitments.

I read there is a requirement of 183 days living in Switzerland for the B permit not to be cancelled. Can anyone please confirm?

He wouldn't be resident in Ireland so would lose the permit there. What he/the company need to find out is how he can work remotely for them without an Irish permit.

This question has come up a few times on the Irish boards and there were two show stoppers:
- Many companies in Ireland require you to working within the jurisdiction, otherwise they could not enforce the privacy requirements etc...
- The permit applications are registered on the SIS, meaning that the country will know about such dual applications.

Thanks everyone for your input.

We donít have any plans of making this a long term set-up. We just thought it could be a good move with the pandemic allowing workers to work remotely, plus my husbandís long term residency being valid until the 2021. Also, would be good to still have dual income during the transition while he learns French and tries to find a job in Switzerland.

If nothing else there will likely be a tax problem and the company I'm sure wouldn't want the hassle. Sure people do it without the employing company knowing but sooner or later it can come out. Some people try to use VPNs to connect to the employer network but I believe it can be seen when someone is doing this.

Normally online boards in Ireland referred to Boards.ie, I've not been there for an awful long time and have no idea is it still the active cesspool it once was.
