C permit Anticipe

I entered to Switzerland in 2006 and studied until 2012 and after I left Switzerland and came back to Switzerland to study until 2019 when I obtained my DBA.

I am working since 2019 for 2 years under L permit. Regarding the below articles. Can I apply for my C permit now?

Conditions posées à l’octroi anticipé d’une autorisation d’établissement :[/B]
Un séjour ininterrompu de cinq ans en Suisse au titre d’une autorisation de séjour : Les séjours antérieurs ou les séjours à caractère temporaire en Suisse (formation, études, traitement médical, cures, séjours de courte durée, etc.) ne sont pas comptabilisés dans cette durée. Les séjours à but de formation ou de formation continue sont néanmoins comptabilisés si, à leur terme, l’étranger a été en possession d’une autorisation de séjour durable pendant deux ans sans interruption (cf. art. 34, al. 5, LEI) ou si le séjour au titre d’une autorisation de courte durée a acquis un caractère durable
en raison, par exemples, d’un contrat de travail de durée indéterminée ou parce queles autorités et l’étranger sont partis de l’idée qu’il s’agissait dès le début d’un séjour durable.

Your time between 2006 and 2012 doesn't count for C permit given you left and so the uninterrupted stay condition is not satisfied. What date of entry does your current permit have?

In any case, you cannot apply with an L permit, you would have to wait until you got a B permit. Whether your years on a working L permit count depends on your canton's interpretation of a durable stay and whether you have been released of working restrictions by your canton's labor authority, are free to change employers and have an indefinite contract.

Thanks for your reply. But in this article, it doesn't mention whether you have an L permit or B permit. It says if you have worked for 2 years without interruption after your formation and you have an indefinite contract you can apply for C permit. Does my study in DBA program count as formation?

It says "d’une autorisation de séjour durable pendant deux ans sans interruption".
L is "autorisation de courte durée"
B is "autorisation de séjour"

The text you quote isn’t an article but an extract of the SEM guidelines. The letter of the law says you need to be in posession of a durable B permit as mentioned above for at least 2 years without interruption for your student years to retroactively count.

What is the date of entry of your current permit?
What is a DBA program and was it obtained from a Swiss public ETH/university/FH?

The entry date is 10.01.2014 and I obtained my DBA from a Private university in Geneva.

See point 5.1.2 of the SEM guidelines which relates to the definition of higher education in application of the 6 months grace period/easier access to foreign graduates of Swiss universities article (to be interpreted systematically with easier access to C permit article as it stems from the same Neirynck initiative).

It mentions graduates must be from a Swiss public higher education establishment i.e. cantonal universities, ETHs, or universities with access to public subsidies. Recognised diplomas are Bachelor, Master, PhD (non exhaustive). Are also considered foreign graduates of a Swiss public higher education establishment those that came only to study a Master or PhD.

Someone correct me if I am wrong, it but also depends whether you are EU, married to Swiss, or Non-EU, or even from some particular countries.
