German Language Requirement for B-PERMIT

Hi Everyone!

I am married to a Swiss citizen. We both live in Luzern. I have a B permit which needs to be renewed every year. If I read it correctly, there is a new law that a language is one of the requirement to renew a residence permit based on family reunification. A Certificate of Language or Enrolment certification for language school will suffice. So my question is. Is it mandatory to enroll for German language school in Luzern or can I study German language in a school in Zurich and does the certificate from a school in Zurich will be accepted in the immigration in Luzern when I renew my residence permit?

Anyone who has first hand experience on the matter or at least have ideas about it.

See Art. 42 vs. Art. 43 & 44.

You only need to prove your language skills once you apply for permit C.

Out of curiosity, non-eu married to a swiss, b-permit is about to expire (family reunification) and both are on social assistance. What will happen? Immigration will kick them out?

"Them" as in both people or "them" as in the non-EU spouse? The authorities can't kick out a Swiss citizen even if he or she is on social help. Citizens have a right to be here. Full stop.

Depending on how long the couple has been married or if the authorities think the marriage is a sham they might carefully consider whether or not to renew the dependent permit. By being on social help, the dependent spouse may run into hurdles requesting a C permit and/or later requesting citizenship.

Also keep in mind that if the couple is on unemployment (RAV) then that's not social assistance. It's an insurance which they paid into while working, and from which they draw when not working.
