Renewal of L permit with a gap between contracts

Hey guys,

Iím non-EU citizen and I have L permit which end 05 July, but my job contract ends later, at the end of July. Except that, I have signed new contract with the same employer, but it starts in November, so the gap between contracts is 3 month.

I have applied for renewal of my permit, enclosed old contract, new contract and bank statement to prove that I can support myself during 3 months.

I will not able be to come back in Switzerland if I leave the country, because swiss embassy in my country is closed due to covid.

How do you think if itís possible to get new permit for 1 year, or they will give me permit only until the end of the current contract, and I will have to apply for new permit from scratch?

You can't apply for a new permit, that's down to your employer to do since I think they'd have to go through the non-EU hiring process all over again. Plus usually the gap between L permit is usually a year at least.

"Chapter 6: Regulation of the Period of stay
Art. 32 Short stay permit

1 The short stay permit is granted for limited periods of stay of up to one year.
2 It is granted for a specific purpose of stay and may be made subject to additional conditions.
3 It may be extended by up to two years. A change of job is only possible for good cause.
4 The short stay permit may only be granted again after an appropriate interruption of stay in Switzerland."

What permit are you here on? According to your other posts it's a family reunification one which isn't affected by your employment.

I described the situation on behalf of my partner. He doesn’t account here.

I wanna ask about current permit which ends 05 July, but current contract ends at the end of July.

Will it be extended for 26 days only?

It may not be extended at all. Why is it shorter than his contract period?

Because it is L permit which was issued for 1 year, until July, 5. But duration of the contract is 1 year and 26 days, until the end of July.

So, thatís why he has to extend current permit.

I think Medea is right, the employer should be the one initiating.

Even so, I highly recommend he does not work the rest of the month until the permit situation is cleared up. Otherwise he could be classified as working illegally - and that would really create problems.

Your permit is the dependent one, then? Does that also expire tomorrow?

Yes, my permit is dependant.

We both received notices from authorities only 3 weeks ago (not 8 weeks before permit expire, in normal situation). Due to covid, there are delays and itís normal. Also Iíve read that ď your stay in Switzerland is permitted and if your previous permit allowed you to work, you may continue working while waiting to receive your new permit.Ē

Abnormal that fact that we can receive new permit in august with expiry date
31 July. In ideal situation we would like to receive new permit, which cover remaining 26 days of current contract, next 3 months and period of next contract (9 months). It looks impossible but meaningful.

You might want to get that in writing, such as an e-mail from the cantonal authorities. Just to be safe. It's possible you read something on the internet that doesn't actually apply to your case, and not realizing that it didn't apply would not excuse someone who ended up working illegally. It is odd they didn't issue a permit for the full duration of the contract in the first place, given that the contract runs through the end of the month.

As I understand thatís because L-permit is issued for 1 year maximum.
