Working in Switzerland as Dependent/ Independent

Hi All,

I am an Indian national working in Germany currently along with my husband. I am on a dependent visa in Germany currently.

Recently, my husband got an opportunity in Switzerland and I am planning to move along with him. I have requested my company for a Swiss contract for the same as well. I also wanted to take this opportunity to request them for an independent visa for me. All of this is currently still under process and approval.

During the course of all this and my research, I have realized that it is not very easy to work in Switzerland, specially as a third national.

What would be the steps my company would have to take for my effective relocation? Note that I'm transferring locations but within the same role. Do they still have to advertise the job across Switzerland and Europe to show they found no-one else suitable?

Would going the dependent route be easier for me vis-a-vis independent? The idea to get an independent work permit was to get more independence/ stability in case my husband gets unemployed/ wants to change location again.

Apologies for the big message and thanks in advance!

Re: Working in Switzerland as Dependent/ Independent

I don't think you have a lot of choice in the matter. Being on a dependent's permit means the company doesn't have to jump through quite as many hoops to employ you here, though I'm not sure if you're transferring that is the case.

For an independent they would definitely have to go through the non-EU hiring criteria and it would mean you probably couldn't come here with your husband since the permit is unlikely to be approved in time, assuming it gets approved in the first place. If it's refused then your husband would then have to apply for a family reunification permit. Since he would no longer have a permit in Germany I don't think you would either so you'd probably have to return to your home country to wait out the decision making process. I'm not sure you could be here while the application is going through.

The non-EU hiring criteria is here

Re: Working in Switzerland as Dependent/ Independent

Thanks Medea!

The information and the link is very relevant and along our line of thought.

Perhaps, its better to go via dependent route to reduce the overall time and complexity of the process but would also check with the company.

Unfortunately, all the pdfs in the document are not in English but should be manageable.
