No, this was the law.

What I am linking is the guidance document issued by the SEM which provides further information of how best to interpret and apply the law.

My interpretation of the guidance document on this subject is as follows:

C permit can be revoked/a deportation can be pronounced at anytime according to art. 63 FNIA (further details under 8.3.2 of SEM guidance) for:
  • lying or hiding essential information from authorities in the renewal/issuance process
  • long-term prison sentences or other penal code sentences
  • posing a threat to public order or is an internal or external threat to Switzerland
  • depending long-term on cantonal/communal social benefits
  • trying to obtain Swiss citizenship in a fraudulent manner

C permit can be downgraded at anytime to a B if the conditions of integration according to art. 58a FNIA are not fulfilled (further details under 8.3.3 and examples in 8.3.3.3 of SEM guidance).

Examples include:
  • Insufficient participation in working life, debt, unemployment (by one's own fault) and that issuing a warning would not change the situation to the better
  • Absence of will of the partner benefitting from family regroupement to learn the language or acquire an education
  • Not fulfilling an integration convention contract to which issuing the C permit was tied to
  • Violation of constitutional values and/or insufficient language knowledge

A refusal to extend the control date of a C permit may only occur if linked to a revocation process (8.3.4 of SEM guidelines).
