Problems about applying family reunification

Hello, everyone.

Hope you are all doing well.

As an non-EU student here in Switzerland, I have registered partnership with my partner (swiss citizen) two days ago and got our certificate from Zivilstandsamt. Now we are starting to do family reunification application. However, I got confused about several problems. Can anyone help me?

Q1: the housing rental contract. My partner actually now co-rent the apartment (2 bedrooms) with the other people, Is it gonna be okay?

Q2: I realized it gonna take quite long time, but my student permit b will get expired 20 days later, can I still stay here during the whole process after my permit get expired?

Welcome to the forum and congratulations on your partnership.

1. This will depend on how many other people there are in the property. Bear in mind for family reunification your partner must show they can afford to support you financially; if they're sharing a property the authorities may not consider that to be the case. Also if you're not already living there, the landlord/agency must be informed that you're moving in.

2. Yes, you can stay while the permit application is being processed.

Good morning and thank you so much for the reply.

It is good to hear that I can still stay here after my permit get expired during this process based on this annoying covid situation. So it will not be illegally stay, right?

For you information, he is co-renting with one other guy who enjoys one bedroom.

Don't take advice on an internet forum as 100% the law. Ask your cantonal migration authority or municipal authority for a letter stating it is okay for you to stay while the family reunification is processing.

I'm applying for family reunification permit as well, and for 1., you need a written permission from the landlord

Yes, I actually sent email to the immigration office too that day but got no answer.
Then my partner phoned them and they told us we need send them both F form and A2 Form along with all the documents, then they will issue a new permit. We have posted all these on Friday and they will start to process this next week. Seems we will finish this on time based on the answer from the immigration people.

Dear Liw, thank you for the reply and hope your application goes well.
FYI, the immigration office just asked the copy of renting contract because it is co-renting. They said the agreement from landlord is required if it is sub-leasing situation.
