Re: Please recommend immigration lawyer in Vaud

We need to get the permit C as soon as possible.
We get controversial info whether all family members should apply for C at the same time or only the primary permit B holder can go first and depending spouse and kids can follow.
Also, we still don't have a clear vision on how to use and benefit from the two passports (EU and non-EU) that my husband holds.

Apply all together via your commune's contrôle des habitants office making sure you include all of the documents in the attached checklist for early C applications issued by the migration authority in canton Vaud.

I'm not sure why you think you need a lawyer at this point. As qwertz said, just apply all together for early C based on the main permit holder having EU nationality. If you are rejected and dispute the reason for not obtaining an early C then you might wish to engage a lawyer, but right now I don't see anything a lawyer can do for you (apart from taking your money).

I once used a Lawyer to clarify the situation re. my C Permit.
He basically spoke to the authorities and told me, what they told him.
Save yourself some money. Talk to them directly.

My thoughts too. You should just speak directly with the authorities. Unless, of course, you're not comfortable speaking in French? In which case, you may not meet the requirements for a C.

Hiring a lawyer just makes them mad. Go direct. And if you struggle with French, well perhaps a C permit is not for you.

Thank you for the checklist.

My husband has B1 language certificate already, but not me (I am still studying). I don't want to pull him back, that is why we thought about him applying early.

Besides, he has 2 passports (got EU one, while working here), but his Permit B is tied to a non-EU passport. So another question is how to transfer years lived here from one passport to another and get a C permit to EU passport.

But if we hire just for consultation and will apply personally?

go to the registration office with the new EU passport and show it to them. They will very likely know what to do from then on.

how early are you trying to get the C and why?

AFAIK you cannot transfer that, the clock resets.

Re: Please recommend immigration lawyer in Vaud

I think you should go to the local registration office and ask them these questions. They will give you advice on what can be done regarding your husband's C permit. Your husband should also be able to ask his HR department for their advice on his permit status (theoretically ...)

If you disagree with how the authorities want to proceed, that is when you might want to find a lawyer to help you.

For now, if the authorities do not know that your husband has an EU passport, he should inform them immediately. They will then decide if that means his B permit is changed to an EU status, and whether that means he is eligible for a C permit after having had a B permit for 5 years (even though he was not an EU citizen the whole time).

Generally, if one spouse is eligible for a C permit, the other spouse also needs to meet the requirements (e.g. with language) in order to also get a C permit. Otherwise, it is common for spouses to have different types of permits. So here, it is possible that your husband and children will have a C permit, but you will have a B permit.
