How to live in Switzerland with working contact from Germany

Hello,
My husband (German) get a job in Switzerland, therefore we need to move our family (including 3 kids) from Germany to Switzerland. However I have a job as specialist in Germany. I am allowed to work from home. I have already permanent visa in Germany.
I still want to work with my German company while I am living with my family in Switzerland.
Could I do that? Which kind of visa and work condition that I need? Please suggest me.

Note:I am none EU citizen, graduated PhD from German Universitie, having 7 years experience in Germany.

You will be able to work remotely in Switzerland for a German company with the family reunification permit you will get based on your German husband’s job. You will be exempt from Swiss health insurance (if you so wish) and will pay the equivalent of German social security in Germany and taxes in Switzerland.

How would she avoid having Swiss health insurance as a Swiss resident?

Also you can't say that she will be allowed to work remotely in Switzerland, only the company can answer that, and because of the tax complications they may well be unhappy about doing it.

Because as she will be working exclusively from an EU/EFTA entity, she would qualify for exemption thanks to her European Health Insurance card issued by Germany.

The employer already allows her to work from home and has no say in what country she takes up residency.

What are the tax complications you mention? It is quite simple, if taxes are withheld in Germany, then she would provide proof of that to the tax authority in her canton, they would settle it directly with the German authority and she would likely even receive some tax back as the effective tax rate is in most cases lower than in Germany.

Incorrect. The company definitely can disallow this as it can have a tax impact on the company.

And EHIC is only for emergencies, not regular health care.

The other question here is do you want to keep your German permanent residency? If so, then no, you can't move here, simple as that. You would have to stay in Germany.

Take the integration course and get yourself naturalised in Germany.

If naturalisation is expected to take too long for you, move close to the Swiss border until the naturalisation has been concluded.

That solves all problems you may have WRT residency: you will have the right to live in Germany, you'll have the right to move to Switzerland any time you chose (while employed). And if things go sour between you parents you won't have to return back home after divorce.

On corporate tax? No impact whatsoever.

EHIC is for emergencies for tourists and for regular care for residents only receiving funds issued from a country other than their residency country (be it a pension or via employment).

Impact on what? Taxes are not due in Germany but Switzerland as she will be physically performing work in Switzerland. The German employer and employee in Switzerland will continue paying for German social security expenses, hence will need not pay for AHV here (as I said in an earlier post).

About data protection, the employee is still legally employed by the German entity and works remotely via a VPN connection (to Germany). What exact data protection rules are you referring to?

The employer already allows the employee to work remotely. Where the employee works from is none of their business.

Not true.

My employer made it pretty clear that we can work remotely from anywhere in Switzerland. However, work from France or any other country is not allowed.

No, I provided all legal avenues to achieve what the OP wanted.

What I didn’t do is make an assumption on what agreement OP may have with her employer or what they may or may not agree with, which we have seen in other posts.
