Family Reunification for Non EU Family living in EU

Hi,

I am a non EU person living in an EU country.

My new employer is a Swiss company and I received an authorisation (Ermächtigung zur Visumerteilung) for myself from the canton.

I am married and have a baby. They are non-EU too and living with me. I want them to come with me in the same time to Switzerland.

I received another document from the canton (via my employer). Canton asks me to provide them with a language course registeration certfication and criminal record of my wife for family reunification. And I already provided with what they wanted.

At this point I have 3 questions:

1. Am I OK to go to embassy with Ermächtigung zur Visumerteilung and apply for the visa for myself?

2. Should I expect or wait to receive anything else from the canton for my wife and son (like my Ermächtigung zur Visumerteilung)? Will canton send anything to us for family reunification? Or are we OK to go ahead and apply a family reunification visa for them at the same time with me?

3. Can I apply for myself and for my wife and son in the same time when I visit embassy? In visa application form there is a section asking to "indicate type and number of the residence permit" which I don't have yet since I haven't had a residence permit? Doest this mean I will have the residence permit first, then my wife and son will come after I migrate there?

Thanks for your answers and comments in advance.

Best Regards

Welcome to the Forum.

I believe you apply for the entire family's Type D visa at the same time. Once approved, it's stamped in your passports. Then you move here and register at the local municipality. The visa is only used for entry into the country. The residence permit allows you to stay and work.

There is no separate visa application. Sounds like you've applied for family reunification already, when it's approved they will get the visa.

Thank you so much. Yes, we are all out of Switzerland at the moment and I will apply a visa for work permit for me and a family reunification visa for my wife and son at the same time.

Basically I wonder if the canton will send a seperate letter of authorization “Ermächtigung zur Visumerteilung” for my wife and son? Currently I received an “Ermächtigung zur Visumerteilung” which only my name is written on it.

Thanks for the answer. I think my employer did it (family reun. application) on behalf of me.

As I said before received I received a visa authorisation (Ermächtigung zur Visumerteilung) for myself. And I also received a cover letter from Canton asking my wife to provide a proof of language course registeration and criminal clerance. Then we provided canton with what they requested.

At this point do you know if I should wait another Ermächtigung zur Visumerteilung for my wife and son or are we good to go to embassy?

Re: Family Reunification for Non EU Family living in EU

It would be a separate document for each person. For adults for sure, doesn't know about kids. And for us family reunification permission came in slightly later - 1 or 2 weeks IIRC. Even though the last required documents (police clearance certificates) were submitted simultaneously.

After that it should be a pretty straight forward (but might depend on country) - get an appointment, bring copy of authorisation and get back a passport with stamped D visa the same day.
