Moving to Switzerland with a contract

Hi,

A friend of mine from Romania (EU) will receive an offer from a Swiss company. They said she has to arrange herself for the work permit.

I have some questions, maybe someone can help me:
1. After she receives the contract, can she apply online for B permit, without moving to Switzerland, and wait in Romania for her permit to be issued?
Canton Zurich allows one to do it online: https://www.zh.ch/en/wirtschaft-arbe...eantragen.html

2. If #1 is not possible, she will move to Switzerland, she will register immediately at the Gemeinde (she will stay with me), and she will apply for the B permit.

In this case, she will have to wait until the permit is issued, before starting to work, right?
What happens if the contract starting date is 1st of March, but the permit is not issued by that date?

Many thanks.

Re: Moving to Switzerland with a contract

Ok, I haven't encountered this situation i.e. to be asked to take care of the work permit, usually it's the company that takes care of that, but I suppose starting with what, 2019? that is a formality and could be done even by the employee. Better ask directly the immigration authorities (Migrationsamt) and check out this link

As for the permit being issued a bit later, that probably happened to each of us (I suppose) when we moved here, it's OK if she starts working earlier.
I hope someone else will be able to provide a more accurate answer. Best of luck.

Re: Moving to Switzerland with a contract

"Gainful employment of more than 3 months:
Within 14 days of their arrival and before actually taking up work, nationals of EU/EFTA states have to register with the local authorities of the commune in which they are residing and apply for a residence permit. A valid ID or passport and a written confirmation of employment (e.g. the contract of employment containing details of the duration of employment and the number of working hours) have to be presented. A residence permit will be issued depending on the duration of employment: a short-term residence permit (type L permit) for employment of up to 364 days or a residence permit (type B permit) for employment of at least one year or for an unlimited period.

The steps necessary for obtaining a residence permit may be taken after arriving in Switzerland."

So long as she registers first then she can start working. No need to wait for the permit to be issued since she'll have to give biometric info at some point in the process.

Re: Moving to Switzerland with a contract

We moved here for my EU-husband's job and all we did was register at the commune when we arrived, we had no advance contact with our commune. He started work the day after we arrived, we received the physical permits I think two months later. Should be fine for your friend to do the same.
