Can I Get a Permit B on the Basis of My Mother's Permit C?

Hi folks,

I am 25 years old and hold Belarussian nationality. I have been residing in Switzerland on Permit B Student for 6 years due to my university studies. I have also been working part-time.

If everything works out, in three years' time, my mother will be eligible to receive her Permit C (she also holds Belarussian nationality).

I would like to know if once she obtains Permit C, I will be eligible to obtain a Permit B that enables me to either reside in Switzerland without gainful employment or to both stay and work in Switzerland.

I know of a friend who obtained such a Permit at the same age as me; however, her mother was a naturalized Swiss national (both were originally Yugoslav).

Yes, he is not considered as a dependent anymore.

Thanks a lot... But that's the thing - I have a friend who received a Permit B without the right to work on the grounds that her mother was naturalized (both were originally Yugoslav). At the time, I believe she was around 25 - she definitely exceeded the 18 year old age restriction!

Could you possibly recommend an institution I could contact regarding this (I'm not sure if it would be OCP or some other authority)? If they made an exception in her case for whatever reason, perhaps they might be willing to do so in mine as well.

The law is pretty clear on the 18 year cutoff. Family reunion is a chapter where the new law (1.1.08) is more stringent than the previous law.

Only the OCP can tell you whether they're willing to bend the law for you.

Thanks again! She did obtain her Permit B about two years ago, so it's possible that the law has changed since and the new provisions (which you referred to) no longer allow this possibility for those over 18.

And this (former) Yugoslav family has the exact history as you in Switzerland, only 6 years here? Seems highly unlikely her mother was able to obtain Swiss citizenship in less than 6 years so I'm guess they've been here much longer and your friend can here originally as a minor.
If that's the case then you can't compare apples with oranges, your situation isn't the same as hers.

Her mother was naturalized because she was married to a Swiss national; he was not, however, the biological father of my friend.

In fact, at the time when she received her Permit B, her mother was going through divorce, although, if I remember correctly, it was not yet formalized at the time. Court hearings definitely took place, though.

However, to the best of my knowledge, my friend arrived in Switzerland at about the same time as me and did not reside here as a minor.
