Urgent Help needed- about the criminal record check!

Hi everyone,

I am a non-EU and have married to an EU for more than 3 years. We have moved to Zurich in Sept and I applied for my residence permit as soon as I arrived.

After two months of waiting, I received a letter from the immigration office and stated that I ought to provide a criminal record check from my own country or the country I recently lived, which was UK.

The problem is that I had lived in the UK and hardly lived in my home country since I became an adult. In the Uk, the current legislation does not allow individuals to apply for a criminal record check on themselves. and my home country doesn't provide a criminal record check as I have not been a resident there for long long time.

So now I am stuck in the middle. Has anybody come across a similar situation? Any advice and suggestions? Is it fair that the immigration department ask for a criminal record check? Does it mean if I had a criminal record, I would not be able to live with my husband in Switzerland even though he has already got a permit?

I may be wrong, but I think that you can apply for a copy of your criminal record in the UK. Here is an example for the Sussex Police:

I also remember (although it is a while since I lived in the UK), that some jobs require that you present a copy of your PNC record before they will confirm your employment.

You can obtain a criminal record check at any police station in the UK. It costs GBP 10.00 and you will receive it within 40 days.
You have to provide ID and request it in person, and explain that you need it for living abroad.

I had to get my own scottish disclosure (criminal record check) when I applied for a contract in Ireland. Type Scottish Disclosure into google and follow the links. You can do it all on-line and it cost me 13.50.

I was in the same predicament. You're not the first. My local police department does not provide criminal records to private citizens. The local gemeinde knew this. They accepted an affidavit from my embassy.

In my case, the ambassador asked me to raise my right hand and place my hand on a Bible and asked "Do you solemnly swear you do not have a police record?". I said "I do", then he signed and stamped the affidavit and sent me on my way.

Ask your embassy. They should know the situation well.

You can get a criminal record check from disclosure scotland, I got all mine done there before I moved to Switzerland. You can apply yourself.

I would just go and explain the problem to your immigration office. I was in a similar situation - the country I was living in at the time did not provide certification of no criminal record. I just explained the situation and the immigration office waived the requirement. Given that immigration is dealt with at communal and cantonal levels I'm sure there are differences in how this is handled but if you've tried to comply and can't then they'll figure a way to move forward. You won't be the first.
