Hello,

I'm stepping into this very interesting tread, which has already helped me a lot.

I am very soon to be (like the author of the original thread) a non-EU spouse of an EU citizen + C permit holder. I realize that when we do get married in a couple of weeks I will be able to apply for a B permit which will include the right to work and that, after 5 years, I'll be eligible for naturalization and a C permit.

My question is this : I have a job in the US, and before committing to coming here and living here we might like to spend some years in the US. When I get this 5 year B permit, do I actually HAVE to reside in Switzerland for it to remain valid? Is there a particular moment when the VISA will expire and it will become impossible for me to return here and work here?

You're not eligible for naturalisation after 5 years. It's twelve years for everyone - unless your spouse is a Swiss national.

Yes, however in your case it is irrelevant as you can get a new one if / when you decide to come back, due to your EU spouse.

can someone help me out here my wife is from EU country Romania and i own student b permit as non eu can my wife get b permit for 5 years since i have b permit for student thanks

She will get the same permit duration as you, initially without the right to work. If she wants to work this is easier in your circumstances as she will not come under the EU-2 quota rules but the employer will still need to apply for a work permit.

But the permit she will get will be B permit if she decided to work?

depending the job? what if she decide to pick an au pair job what permit will she get since i heard that au pair are given L ,permit need more advice on this thanks

Au pairs are special with specific requriements such as language class provision. Only non EU people should register as an Au Pair. EU citizens doing a similar role should register as a mother's help or similar.
