Unemployment Insurance

Hi Everyone

I have a question about my unemployment insurance.

My unemployment period(Rahmenfrist) is about to complete end of April this year which has been started two years back. I have worked about 15months within this two years of unemployment period(Rahmenfrist).

The person in-charge in RAV told me that I need to make a new request to have a new unemployment period(which is for two more years since I have worked about 15months in the current unemployment period which is about to complete shortly).

With the above situation, I would like to receive answers for the following questions:

1. I am expecting the renewal of my work permit(B). Is that the renewal depends on the approval and opening of my new unemployment period(rahmenfrist)?

2. Is it really true that I should make a request to get another two years of unemployment period? Isnt that automatically been open for two more years of unemployment period since i have worked for more than a year during the current unemployment period?

3. If I should make the above request, should I submit this request(Antrag formular - yellow coloured one) as soon as possible or else just one week before the completion of the first unemployment period?

4. If I make a request for new unemployment period, do they surely approve and open it for two more years of unemployment period? How can I clarify this situation?

Your situation seems to be out of the norm, so I do not expect that there will be anyone able to help you here. As NatsBrit has already said, the best people to answer this is the RAV.

I would be surprised if they renewed your B permit, since an employer must normally apply for such a permit and not the employee. I know that if you become unemployed while on a B permit you are normally allowed to stay until the permit runs out, but that is the end of line and you must leave. I don't know if that is the case for you or not, as I say talk to the RAV people.

That's not quite right. You're allowed to stay until your unemployment payments run out. The RAV effectively becomes your employer and your permit is renewed accordingly.

Thank you for your reply.

But my current unemployment period will complete in the end of April 2009. But in this unemployment period I have worked about 15months. Due to this fact, I must get two more years Unemployment period, as per the official. I believe its true.

The RAV personnel ask me to fill up the new request form for Unemployment Insurance so that the new Unemployment Insurance will be opened from thereon. Isnt it this one is automatic? Is this true that I should submit the yellow coloured Form(Antrag für Arbeitslosen Entschädigung, something like this)? When should I submit this form? Will they surely open two years Unemployment Insurance if I submit this form?

Please kindly advice. Thank you very much.

You need to have made 12 contributions during the past 2 years to be entitled to the insurance. If you have worked during the insurance period, this adds up to days you can receive.

Regarding the papers, I cannot say for a fact if you need or not need to resubmit them. Normally, the Kasse who pays you sends letter and notifications when they need more info or things need further explanation. If in doubt, contact them directly and ask them what sort of paper work you should submit and if this is necessary. (Not the RAV counselor, but the Kasse who is paying you). If the counselor is asking to send them paper work, i would take it seriously. It seems logical to me also that the Kasse would need to confirm that you have made at least 12 contributions during the past 2 years to keep on paying you (things are not centralized and you need to make sure the right persons have the right information). But again, give the Kasse a phone call to avoid surprises.

Regarding your permit, Shorrik is absolutely correct - in principle you will be able to stay in the country as long as you looking for a job.
