permit upgrade?

I am a US citizen and have what appears to be a limited B permit (36 months and employer info appear on it, so I guess this is a bad sign of being a limited B permit).

So the question is, how does one go for an upgrade to unlimited B permit ?

Thanks,
Alex.

You have to be here 5 years to upgrade your permit to a C Permit unless
you marry a Swiss person that is.

Re: permit upgrrade?

My contract is unlimited (nowhere does it state the time limit). Yet my B permit says 36 months. It gets even funnier, my wife who is EU citizen has a different B permit (EG/EFTA) ... very odd.

I feel like I need an expert to help me make any sense of it. Does anyone know a good immigration lawyer to consult with?

Thanks,
Alex.

Re: permit upgrrade?

You're wasting your time and money on an immigration lawyer!!

Since you are married to an EU citizen, it might be slightly different.

I am married to an EU citizen. She received a 5 year B permit instantly.
After one year, I received the same 5 year B permit as she has.

You don't say that your wife is employed. A third-country spouse of an EU/EEA citizen gains EU rights by virtue of the status as economic operator, however little time spent and however little money earned as such. (ECJ Levin case: http://bit.ly/NYpso )

Otherwise the rules are here:
http://www.multifiduciaire.ch/fr/vir...pdf/perm_b.pdf (in general, Non-EU B permits are annual in duration; EU B permits are usually for 5 years.

In a brief search of government documents online I found no legal support for issuing a B permit for 36 months. Which doesn't mean anything since you seem to have one. There is more information on the following site and on pages linked on it: http://bit.ly/18NxfH

Re: permit upgrade?

Basically, my understanding is that if you are married to an EU citizen you won't have any problems at all ....

We are nonEU and got a '1 year' L permit, but on renewal we were told that actually, the authorities pre-approved for 2 years, so the renewal was simply a formality - as long as my husband's employer confirmed that he's still working for them, they re-issued the permit - so obviously they have some 'system' where what is said on the permit is not 'exactly' what is going on behind the scenes...
