Coming Back to CH

First of all, I would like to thank personally "English Forum", Where i am getting all the useful information and also doubts clarified by the experts.

Hope this time too.

I am currently in India, I came from Switzerland after completing my 2 yrs contract with famous company (Not to mention the company name).

Currently, I am proposed again for a contract. I am not sure about my future contract tenure, how long will it be. Initial sign off would be potentially for 1 yr and then it can be extended (I am not sure about it).

I need your suggestion or advice, like what kind of permit that I would be getting if I am coming next year (Feb 2010).

My issue is I need B permit, so that my wife can work without any problem.

Kindly suggest your opinion on this.

Is the company your working for sorting out your work permit? in the current climate I don't fancy your chances of being given a permit.

Re: Coming Back to CH

Did you have a B permit when you were here for 2 years..? the chances that you will get the same type of permit is very likely..

I just see that you are coming here from the Indian company.. if i understand it correctly then you will not be employed by the Swiss company directly, but through the Indian one.... right?

Re: Coming Back to CH

So your woking for an outsourcer eg infosys? in which case you have a limited work permit tied to the job, you can't transfer it and I don't think your wife is allowed to work either.

They don't issue permit on an individual's request, which obviously you must be knowing as you have already worked here. I presume you will be issued limited work permit L and with that, your wife will not be allowed to work.

Re: Coming Back to CH

Permit L if you get posted to Switzerland. Papers to be handled by your Indian company or yourself with the embassy at Delhi. If the company from Switzerland is hiring you then their H.R. will handle it.

And no assurance as you just might get a business Visa only - valid for 3 months entry at the max untill the Indian Company has an exisistent office with an address in Switzerland.

No wife cannot work untill she gets a job herself - also immaterial even if you have Permit B. Rules for us Asians are different from EU Nationals. She will always get a dependent Permit (L or B) untill somebody is willing to hire.

And anyone trying to hire her would have to prove that no one in switzerland or the EU could do the job.

This is not quite correct. This requirement is not necessary IF the op gets an unrestricted B permit.

Re: Coming Back to CH

As above said, my company will take care of the paper works. my point is, i have already lived in CH for 2 yrs in CH. Will it be like, if i come again I get a B permit or L Permit.

And my next question is, Either L or B - My wife will be able to work, if she suppose finds a job in CH.

your questions have been answered already.

No she wont be able to work, and its very unlikely any company would be able to offer her a job or would want to go through the hassle of getting her a work permit.

the lenght of time you have been here before makes no difference.

Re: Coming Back to CH

Answer is L Permit.

As for your wife - if she finds a job - it is a seprate Issue - seprate application when she gets a job - She will too get a Permit L. Right now she will only get a dependent permit with no work allowed.

You can live here as long as you want. On return once you have left the whole process starts again.

Only Permit C holders can leave the country for 2 years and then come back to still have their Permit C. (if this has not changed this year after schengen agreement)

Re: Coming Back to CH

To the best of my knowledge you will get a L permit irrespective of your previous two years of working here in Switzerland.. and if your wife gets a job here then her company will do the needful regarding her work permit. However she cant work on your B permit even if you were to get one.. she can live here as a dependant, but it does not entitle her to work

If you a limited contract for the new job, you would very likely get a L again. But for a neu L permit, you must leave CH for 12 months.

But because you had a L permit for your last job for 2 years, if you could get a indefinite work contract, your employer could make an application for a B Permit.

Your wife might work with a dependent B Permit without additional applying a work permit.

Good luck!

Thanks, KliKling! That's very useful. My German is not up to par yet, but google translate does wonders.

I'm married myself and my future employer has applied for a B for me. Fingers crossed...

Only if the OP had not left Switzerland.
